Mr. Aidt called the meeting to order at 4:30 p.m. He shared that Mr. Hill could not attend the meeting and asked to be excused, and Mr. Lauterbach had asked to be recused due to prior work with the applicant.

It was moved by Mr. Byington and seconded by Mrs. Gowdy that both absences be excused; the motion was approved by viva voce vote.

Mr. Aidt asked if there were any questions or concerns with the minutes from the September 4, 2024 meeting. There being none, it was moved by Mr. Byington and seconded by Mrs. Gowdy that the minutes be approved as submitted and the reading thereof be dispensed with at this session. Upon a viva voce vote on the question of the motion, the same passed unanimously and it was so ordered.

Mr. Aidt provided an overview of the meeting agenda and reviewed the meeting procedure with all in attendance. He explained that with only three members in attendance, it would take a unanimous vote of all three to transact business. He then invited Mr. Kroger to present the staff report for Application 24-7.

Mr. Kroger shared that Application 24-7 was filed by Tom and Alison Davis to change the use of an existing rear yard patio to a tennis (pickleball) court. The rear yard patio was constructed this past summer and is an approved use under the Zoning Code. The applicant had originally intended to install a “multi-use sports court” but installed a patio instead due to ongoing construction at the property, time constraints, and zoning rules and regulations.
