LOCAL LAW #2 of 2026

A LOCAL LAW titled Town of Cicero Local Law #2 of 2026 and known as the "Temporary Moratorium" prohibiting any zone change or special permit applications related to the establishment of large-scale data centers, artificial intelligence (“AI”) computing facilities, cryptocurrency mining operations, and similar high-intensity computing uses and complexes in the Town of Cicero.

IT IS HEREBY ORDAINED AND ENACTED by the Town Board of the Town of Cicero, Onondaga County, New York, as follows:

That Town of Cicero Local Law #2 of 2026 titled “Temporary Moratorium” is hereby adopted to enact a twelve (12) month moratorium prohibiting the application or approval of any new zoning requests, special permits, and/or land use approvals related to data centers, artificial intelligence computing facilities, cryptocurrency mining facilities, and/or high-intensity computing sites.

The purpose of this Local Law is to establish a temporary moratorium on the acceptance, review, and approval of any applications for zone changes, special permits, site plan approvals, and other land use or development approvals associated with data centers, artificial intelligence computing operations, cryptocurrency mining operations, and/or other high-intensity computing uses within the Town.

The moratorium is intended to provide the Town Board with sufficient time to study, evaluate, and consider the adoption of new Town Code provisions and land use regulations governing such uses and their potential impacts on the community, infrastructure, utilities, and environment.

This temporary moratorium may be amended, extended, or terminated by the Town Board as it deems necessary and appropriate.

Said Local Law shall read as follows:

LOCAL LAW

“Town of Cicero Local Law No. 2 0f 2026 is hereby enacted, providing for a Temporary Moratorium, for a period of twelve (12) months after the date of filing of this Local Law.

SECTION 1.    PURPOSE

The Town Board of Cicero finds that the rapid expansion of large-scale data centers, artificial intelligence (“AI”) computing facilities, cryptocurrency mining operations, and similar high-intensity computing uses may present significant impacts upon municipal infrastructure, public utilities, environmental resources, emergency services, land use compatibility, and community character. Due to these concerns, the Town Board decided to implement a local law providing a Temporary Moratorium for twelve (12) months after the date of the filing of this Local Law.

SECTION 2.    TIME PERIOD AND PROHIBITION
A.
As of the effective date of this local law there will be a twelve (12) month moratorium on all Town Board land use decisions related to data centers, artificial intelligence computing facilities, cryptocurrency mining facilities, and/or high-intensity computing sites in Cicero.
SECTION 3.        EFFECTIVE DATE

This Local Law shall take effect immediately upon filing with the Secretary of State.

SECTION 4. TERMINATION DATE

This local law shall become null and void twelve months after filing, unless extended or terminated by the Town Board. The proposed moratorium may be extended, or terminated at any earlier period, by the Town Board.

Cicero Data Center Action Plan

In order to guarantee prompt progress in delivering a plan to best handle potential Data Center projects in the Town of Cicero, The following steps will go into effect upon the Town Board voting to approve a one-year moratorium.

Dateline Action
By 9/1/26 Task Force Formed

The Task Force will include: Town Supervisor, Codes Dept., Town Engineer, Highway Dept. representative, Town Board member, Town Attorney, Planning Board Chair, and two Cicero residents. Virtual meetings will be established.

TBD Receive and Review Studies

The Task Force will read and review studies from NY State, Onondaga County and Center State CEO when they become available.

TBD Independent Research

The Task Force will independently read and review Data Center information in the public Domain as it becomes available. All members must seek out and review public data. Information will also be shared with the Task Force as it becomes available.

March 2027 Codes recommendations

The Codes Department, acting on information they have acquired through the Task Force, and other Towns, will draft codes recommendations for Data Centers to be codified into Town Law.

June/July 2027 Town Board Vote

The Cicero Town Board will vote to extend the Data Center moratorium, or to place code guidelines on Data Center construction.

7. Public Hearing to consider the approval of the Cable Television Franchise Agreement between Spectrum Northeast, LLC, an indirect subsidiary of Charter Communications, Inc., and the Town of Cicero

Move for the adoption of a resolution to approve and authorize the Supervisor to execute the Cable Television Franchise Agreement between Spectrum Northeast, LLC an indirect subsidiary of Charter Communications, Inc. and the Town of Cicero as follows:

In the Matter of the Granting of a Cable Television Franchise Held by Spectrum Northeast, LLC in the Town of Cicero, County of Onondaga, New York

RESOLUTION

An application has been duly made to the Board of the Town of Cicero, County of Onondaga, New York, by Spectrum Northeast, LLC, an indirect subsidiary of Charter Communications, Inc. (“Charter”), a limited liability company organized and existing in good standing under the laws of State of Delaware doing business at 815 Erie Blvd E, Syracuse, NY 13210, for the approval of a renewal agreement for Charter's cable television franchise for fifteen (15) years commencing with the date of approval by the Public Service Commission.

The franchise renewal agreement would bring the franchise into conformity with certain provisions of the Federal Cable Communications Policy Act of 1984, as amended, and certain court rulings.

A public hearing was held in the Town of Cicero, New York on Wednesday, July 22, 2026, 6:00 p.m., and notice of the hearing was published in the Post-Standard on Tuesday, July 14, 2026.

NOW, THEREFORE, the Board of the Town of Cicero finds that:

  1. 1. Spectrum Northeast, LLC has substantially complied with the material terms and conditions of its existing franchise and with applicable law; and
  2. 2. Spectrum Northeast, LLC has the financial, legal and technical ability to provide these services, facilities and equipment as set forth in its proposal attached; and
  3. 3. Spectrum Northeast, LLC can reasonably meet the future cable-related community needs and interests, taking into account the cost of meeting such needs and interests.

BE IT FURTHER RESOLVED that the Board of the Town of Cicero hereby grants the cable television franchise of Spectrum Northeast, LLC and the Town of Cicero for fifteen (15) years commencing with the date of approval by the Public Service Commission and expiring fifteen (15) years hence.

BE IT FURTHER RESOLVED that the Board of the Town of Cicero hereby confirms acceptance of this franchise renewal agreement.

8. Set Public Hearing - To Consider a Planned Unit Development for Property Located at Brewerton Road & Meltzer Court, Cicero Community Campus (Tax Map No. 092.-01-03.5), TR Owner, LLC, Proposed Multi-Residential Apartments (The Roman)

Move for the adoption of a resolution calling a Public Hearing to be held on August 26, 2026 at 6:00pm at Cicero Town Hall 8236 Brewerton Rd, Cicero, NY to consider the application of TR Owner, LLC, for a Planned Unit Development (PUD) located at Brewerton Road and Meltzer Court within the Cicero Community Commons PUD (Tax Map No. 092.-01-03.5). The proposed project involves the development of an apartment complex consisting of a 74-unit apartment building and associated clubhouse.

Move for the adoption of a resolution to approve Screen Art Graphics located at 136 Eureka Street, Syracuse, NY 13204 for the production of Recycle Stickers which are no longer being provided to the Town of Cicero by OCRRA (Onondaga County Resource Recovery Agency) at the rate of $1.85 maximum per sticker with the amount not to exceed $820.00 for 500 stickers. Budget code: 080-8160-4000-0000 (Refuse Fund Contractual).

Move for the adoption of a resolution to approve the rental of a tub grinder (July & November) from Clifton Recycling (county contract) to tub grind this year’s brush accumulation in the amount not to exceed $35,000.00. Budget Code 080-8160-4000-0000 (Brush and Garbage Fund Contractual).

Callanan for Additional Asphalt Vendor

Move for the adoption of a resolution to approve Admar Construction Equipment (State Contract #PS70900) in the amount of $15,000.00. Budget Code 003-5110-4400-0000 (Equipment Rental).

Hire Jim Bamonte, Music Teacher

Move for the adoption of a resolution to hire Jim Bamonte, Music Teacher, at a rate of $35.00/hour for the purposes of instructing music camp with a start date of on or around July 28th, 2026. Budget code: 002-7020-0105-0000 (Program Staff/Town Employees).

2026 Alert Kit Grant

Move for the adoption of a resolution to accept the award for the 2026 IceAlert Kit Grant in the amount of $1,375, funded through the PERMA Return of Member Equity (RoME) Program. This grant supports workplace safety initiatives designed to reduce workers' compensation claims, minimize workplace hazards, and improve overall safety outcomes. The IceAlert Kit will be utilized during the winter season to help staff identify and respond to icy conditions, enhancing the safety of Town employees as well as the general public.

Bus Maintenance

Move for the adoption of a resolution to move $4,700 from the $16,700 GovDeals auction proceeds and transfer it to Account 001-6772-4300-0000 – Bus Maintenance to cover additional repair expenses, including brake lines, air compressor lines from the air conditioning unit, which exceeded the amount budgeted for these repairs.

Annual Contribution from Friends of the Canteen

Move for the adoption of a Resolution to accept the annual contribution from Friends of the Canteen.

WHEREAS, Friends of the Canteen has provided an annual contribution to the Town of Cicero in the amount of Thirty-Five Thousand Dollars ($35,000.00) to support Canteen programs and activities; and

WHEREAS, the Town Board wishes to formally accept this contribution;

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Cicero hereby accepts the annual contribution from Friends of the Canteen in the amount of Thirty-Five Thousand Dollars ($35,000.00).

15.Contract for Completion of MS4 Mapping

Move for the adoption of a resolution to approve the following resolution:

WHEREAS, the NYSDEC MS4 General Permit for Stormwater Discharges GP-0-24-001 requires comprehensive system mapping of all stormwater outfalls, interconnections, infrastructure (catch basins, pipes, ditches, culvert crossings, etc.) and more for each MS4 municipality, and

WHEREAS, the on-line map is hosted by the CNYRPDB, and
Whereas Barton & Loguidice has been contracted by the CNYRPDB to update the mapping to the extent available in their contract amount, and

WHEREAS, the number of assets needing to be mapped in the Town of Cicero exceeds the Town’s allocated share, therefore be it

RESOLVED to allow the Supervisor to sign a proposal from Barton & Loguidice to complete the required MS4 mapping for the Town of Cicero at a cost of $19,840 (Budget Code 060-8540-4000-0000).

*16.Extend the Contract with Superior Waste Removal, Inc., for the Town of Cicero Collection and Disposal of All Refuse, Rubbish, Garbage and Recyclables

Move for the adoption of a resolution to extend the contract with Superior Waste Removal, Inc., under the same terms and conditions of the original contract for the first additional period allowed in the contract and authorize the Supervisor to execute any necessary documents; thereby extending the contract until December 31, 2027.

17. Town of Cicero Website Management Agreement

Move for the adoption of a resolution that the Town Board approves and authorizes the Town Supervisor to sign an agreement with Kishmish for a one-time refresh of the Town of Cicero Website for $3,000.00, add ADA compliance support and ongoing maintenance for $115.00 per month (paid annually) and replace the current website manager. Budget Code 001-1680-4000-0000 (Computer Labor Departmental).

Move for the adoption of a resolution that the Town Board approves and authorizes the Town Supervisor to renew the Intermunicipal Agreement with BOCES for The Providing of Technology Services through December 31, 2026. Budget Code 001-1680-4000-0000 (Computer Labor Departmental).

19. Cicero Falcons Booster Club Fireworks Application

Move for the adoption of a resolution to approve and authorize the Supervisor to execute the Fireworks Permit and waive (non-for-profit) the $100.00 permit fee (Town Code Chapter §109-1(G) from American Fireworks Display, LLC to be held on August 28, 2026 (after the game). The sponsor of the show: Cicero Falcons Booster Club. All acquired signatures have been obtained.

20. Acceptance of State and Municipal Facilities Program

Move for the adoption of a resolution to accept the State and Municipal Faculties Program (SAM) That Assemblyman Stirpe awarded to the Town of Cicero for the reconstruction and repaving of the Cicero Town Hall Parking Lot, in the amount of $125,000. Authorize the Supervisor to execute any documents.
