AN ORDINANCE TO AMEND AN ORDINANCE
REGULATING TRAFFIC ON CERTAIN PUBLIC STREETS IN
DELAWARE COUNTY
WHEREAS, the Board of Commissioners are charged with protecting the health and welfare of the citizens of Delaware County; and
WHEREAS, the Board of Commissioners are obligated to review and, if necessary, amend the Street and Road Regulations of the County Highway System to allow for the more orderly and safe mode of travel on the roads; and
WHEREAS, the Board of Commissioners will conduct a public hearing on June 1, 2026 with respect to a number of all way stops and speed limit changes; and
WHEREAS, there have been changes to the density of the street that is built up with structures, single family homes situated at intervals of less than two hundred (200) feet for a distance greater than one-fourth (1/4) of a mile to meet the definition of an “urban district” in the areas where the speed limit is to be changed pursuant to I. C. 9-13-2-193; and
WHEREAS, changers have occurred along 26th St. from Hoyt Ave. to the west to Tillotson Ave. wherein the speed limit was reduced to 20 mph because of a school being present. Now the school has closed the speed limit reduction is no longer needed; and
WHEREAS, the Board of Commissioners determine that an alteration of the maximum speed limit is required for the safety of the residents in the areas identified below pursuant to I. C. 9-21-5-6(a)(1); and
WHEREAS, the Board of Commissioners determine that certain changes will be necessary to the Delaware County Code, Title 5, Chapter 4, Street and Traffic Regulations.
THEREFORE, BE IT ORDAINED: By the Board of County Commissioners, Delaware County, Indiana that Delaware County Code, Title 5, Chapter 4, Street and Road Regulations shall be amended as setforth herein:
