AN ORDINANCE TO AMEND AN ORDINANCE
REGULATING TRAFFIC ON CERTAIN PUBLIC STREETS IN
DELAWARE COUNTY
WHEREAS, the Board of Commissioners are charged with protecting the health and welfare of the citizens of Delaware County; and
WHEREAS, the Board of Commissioners are obligated to review and, if necessary, amend the Street and Road Regulations of the County Highway System to allow for the more orderly and safe mode of travel on the roads; and
WHEREAS, the Board of Commissioners determine that certain changes will be necessary to the Delaware County Code, Title 5, Chapter 4, Section 8, Weight Limits on local road.
THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF DELAWARE COUNTY, INDIANA, that the Delaware County Code, Title 5, Chapter 4, Street and Road Regulations shall be amended as setforth herein:

Title 5, Chapter 4, Section 8, is to be amended as follows:
- a. There shall be a weight limit of 6 tons (Class 6 trucks or greater) for vehicles using CR 400 South from Cowan Road west to SR 32.
- b. No class 6 trucks or greater may use CR 400 South from Cowan Road to SR. 32 except as permitted in this ordinance.
- c. There shall be a weight limit of 6 tons for CR 600 West from SR 67 north to the Town limits of Yorktown, Indiana as permitted in this ordinance.
- d. There shall be a weight limit of 6 tons for CR 700 West from SR 67 to SR 32 as permitted in this ordinance.
- e. There shall be a weight limit of 6 tons for CR 800 West from SR67 to CR 400 South as permitted in this ordinance.

2.
Any Class 6 trucks or greater making local deliveries to businesses or residences along the above stated roads are permitted.

3.
Agricultural vehicles in excess of the weight limit setforth above are permitted on the above stated roads so long as they are engaged in farming operations along or near CR 400 S from Cowan Road to SR 32.

The County Highway Department of Delaware County, Indiana, is hereby authorized to erect appropriate signage pursuant to the Indiana Manual on Uniform Traffic Control Devices.

The penalty for violation of this ordinance shall be as herein setforth in Article XVI, Section 16-1.

This ordinance shall be in full force and effect from and after its passage and publication.
