WHEREAS, pursuant to Ind. Code Ann. § 12-29-2-15(a), each county located within a community mental health center's primary service area where the center maintains its corporate mailing address may designate a member of the county fiscal body or a member of the board of county commissioners (or a designee) to serve on the center's governing or advisory board, subject to certain provisions in the statute; and
WHEREAS, Meridian Health Services, Corp. is a community mental health center that is certified by the division of mental health and services and is not administered by a hospital licensed under I. C. 16-21-2 et. seq. and maintains its corporate mailing address of 240 N. Tillotson Ave., Muncie, Delaware County, Indiana; and
WHEREAS, the Board of County Commissioners of Delaware County, Indiana, desires, pursuant to Ind. Code Ann. § 12-29-2-15(a) to select a member of the County Board of Commissioners or the County Fiscal Body to serve on the governing or advisory board of Meridian Health Services, Corp. a community mental health center within the primary service area of this County; and
WHEREAS, the Board of Commissioners of Delaware County, Indiana believes that a member of the Board of Commissioners or their designee should be appointed to serve on the Board of Directors of Meridian Health Systems.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF DELAWARE COUNTY, INDIANA, as follows:
Section 1. The Board of County Commissioners of Delaware County shall designate one of the members of the Board of Commissioners or a designee to serve on the governing board of Merdian Health Services, Corp. a community mental health center in accordance with the provisions of Ind. Code Ann. § 12-29-2-15(a).
Section 2. The selection of the person to serve on the governing board of Meridian Health Services, Corp. shall be made by a majority vote of the Board of County Commissioners of Delaware County.
Section 3. The person selected under this ordinance shall serve a one (1) year term. The person selected shall continue to serve until a successor is duly appointed. In the event that the appointee is an elected official, when their term of office expires, then their tenure as the appointee of the Commissioners shall also expire.
