Community Development Assistant Director Mike Gottfredson presented Ordinance #25-416, An Ordinance Adopting the County Land Use Fee Schedule. He explained the changes, which included fees, the addition of an Administrative Conditional Use Permit, the Appeal of Decisions and Costs, and the Floodplain Development Permit. Commissioner Chugg asked about the paved and gravel roads, how the fee would apply, and if it is covered in the ordinance.

Public Comments

Zane Lay with FourPoint Resources said his company joined the conversation about the ordinance three days ago, so they do not have any comment. However, he is concerned with Section 1, Page 3—Duchesne County shall use Transportation Service Fees collected at its sole discretion for lawful purposes. He thinks the fees collected should be used on roadways affected by oil and gas. He would also like more clarification on the cap for gravel and paved roads when the same well affects both.

Jeff Crozier with Crescent Energy asked if there is a template for the Road Maintenance Agreement and if they could see the options. He also asked why they would have to pay conditional use and transportation mitigation fees if the gravel road is not recognized as a County Road.

Community Development Assistant Director Mike Gottfredson recommended that the public hearing be recessed until a future date for more clarification.
