OAKWOOD COMMUNITY IMPROVEMENT CORPORATION

WHEREAS, the city of Oakwood is an Ohio charter municipality, and the Oakwood Community Improvement Corporation (“Oakwood CIC”) is an Ohio nonprofit corporation acting as the designated agency of the city of Oakwood for economic development purposes in accordance with Section 1724.10 of the Ohio Revised Code; and

WHEREAS, because of its status as a designated city agency, the Oakwood CIC may, but is not required to, generate and/or maintain certain records in the course of its operations that may be deemed public records under the provisions of Section 149.43 of the Ohio Revised Code, also known as the Ohio Public Records Act; and

WHEREAS, for that reason, it is necessary and desirable that the Corporation adopt an administrative policy pursuant to Section 149.43(B)(7) of the Ohio Revised Code, setting forth procedures to be followed in responding to a request for public records;

NOW, THEREFORE, BE IT RESOLVED BY THE OAKWOOD COMMUNITY IMPROVEMENT CORPORATION, THAT:

For the reasons set forth above, the Oakwood CIC hereby adopts for itself City of Oakwood Administrative Policy No. 7, as the same may be supplemented and amended from time to time, with all references to the city or to city staff deemed to refer to the Oakwood CIC, its officials, and city staff to the extent that they may assist the Oakwood CIC in its response to a public records request. A copy of City of Oakwood Administrative Policy No. 7, in its current form, shall be appended to the minutes of the Oakwood CIC meeting at which this resolution was adopted.

The adoption of this resolution shall not be construed as an admission or representation that the Oakwood CIC is a public office within the meaning of Section 149.43 of the Ohio Revised Code. The Oakwood CIC is, and remains, an Ohio nonprofit corporation separate and distinct from the Ohio municipal corporation known as the city of Oakwood.
