A RESOLUTION
WHEREAS, Council of the city of Oakwood, Ohio, hereby declares the necessity of an additional levy in excess of the ten-mill limitation for the purpose of meeting current expenses for the general operation of the city’s governmental services; and
WHEREAS, pursuant to Section 5705.03 of the Revised Code, Council is required to certify to the Montgomery County Auditor a resolution requesting the total current tax valuation of the city of Oakwood and the number of mills for each one dollar of taxable value that is required to generate a specified amount of revenue;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF OAKWOOD, MONTGOMERY COUNTY, OHIO:
SECTION I.
That pursuant to the provisions of Section 5705.19(A) of the Revised Code, it is necessary that a tax be levied in excess of the ten-mill limitation for the benefit of the city of Oakwood, for the purpose of meeting current expenses for the general operation of the city’s governmental services, at the rate that will generate annual revenue in the amount of One Million One Hundred Thirty Seven Thousand Two Hundred Twenty Four Dollars ($1,137,224.00) for a period of five years.
SECTION II.
That pursuant to the provisions of Section 5705.03 of the Revised Code, the County Auditor is hereby requested to certify to the city of Oakwood the total current tax valuation of the city of Oakwood and the number of mills for each one dollar of taxable value that is required to generate the amount set forth in Section I hereof, and the Clerk of Council is hereby directed to certify forthwith a copy of this resolution to the County Auditor upon its passage.
SECTION III.
That if, upon receipt of the County Auditor’s certification, Council determines to proceed with said levy, the question of the passage thereof shall be submitted to the electors of the city at an election to be held on March 19, 2024. If a majority of those electors voting on this levy vote in favor thereof, the levy will be first placed on the tax list and duplicate for tax year 2024, for collection in calendar year 2025.
SECTION IV.
It is found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION V.
This resolution shall take effect and be in full force immediately upon its passage.
