AN ORDINANCE

REPEALING ORDINANCE 2151 AS IT PERTAINS TO SALARIES OF COUNCIL MEMBERS AND THE MAYOR AND ADOPTING, PURSUANT TO CHARTER SECTION 2.05, AN INCREASE IN THE COMPENSATION PAID TO COUNCIL MEMBERS AND THE MAYOR FOR THEIR SERVICES TO THE CITY OF OAKWOOD, OHIO AND ITS CITIZENS.

WHEREAS, pursuant to Section 2.05 of the City Charter, Members of Council for the City of Oakwood are permitted to establish by ordinance the salary to be paid to their successors in office, provided that any such ordinance is passed at least one hundred (100) days prior to a regular municipal election at which a majority of the Council Members are to be elected; and

WHEREAS, by prior Ordinance 2151, enacted July 11, 1960, compensation for regular Council Members was set at $480.00, and compensation for the Mayor was set at $720.00, to remain until changed by further Ordinance; and

WHEREAS, these salaries for regular Council Members and the Mayor have remained unchanged for fifty years, and have not been adjusted to account for inflation; and

WHEREAS, Council is entitled to receive just and reasonable compensation for the work, services, and duties it and its respective members perform, and such compensation is required to attract and retain qualified candidates for Council positions; and

WHEREAS, the Consumer Price Index, a commonly used inflationary index promulgated by the United States Department of Labor, has increased by 724% since the prior enactment of Council salaries;

WHEREAS, applying the 724% CPI increase realized over the past 50 years, the present value of the 1960 salary amounts are $3,476 and $5,214 for Council Members and Mayor respectively; and

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OAKWOOD, MONTGOMERY COUNTY, OHIO, THAT:

SECTION I:

Sections 2.1 and 2.2 of Ordinance 2151, which established salaries of $480.00 per year for regular Council Members and $720.00 per year for the Mayor, are hereby repealed. The remainder of Ordinance 2151 shall remain in full force and effect, except to the extent that the same may have been otherwise repealed, amended, or otherwise modified.

SECTION II:

The salary of regular Council Members, pursuant to Section 2.05 of the City Charter, shall be increased to $2,800.00 per year and paid as allowed by law, until otherwise changed by ordinance.

SECTION III:

The salary of the Mayor, pursuant to Section 2.05 of the City Charter, shall be increased to $4,000.00 per year and paid as allowed by law, until otherwise changed by ordinance.

SECTION IV:

The City Manager and Director of Finance are hereby directed to make the appropriate changes in compensation in accordance with this Ordinance, the City Charter, the City Code, and the laws of the State of Ohio at such time as provided by law.

SECTION V:

It is hereby found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that any and all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements, including, but not limited to Section 121.22 of the Ohio Revised Code.

SECTION VI:

This Ordinance shall take effect at the earliest date provided by law; provided that the same shall not take effect as to the compensation to be paid to any current elected or appointed Council Member during their current term of office.
