Staff Update – Ordinance #25-420
Community Development Director Mike Hyde explained that TransWest Express LLC is constructing a new direct current (DC) power transmission line from southern Wyoming to the Las Vegas area. The applicants purchased several lots in Vista Valley Estates, Unit 6, to facilitate powerline construction and are seeking to amend the plat to consolidate the small lots, vacate and relocate some roadway sections, and vacate some utility easements that are no longer necessary for the development of the amended lots.
The Planning Commission, on May 14, 2025, conducted a public hearing in accordance with Utah law and the county subdivision ordinance regarding the proposal. After hearing that the plat amendment results in lots becoming less non-conforming and that none of the local utility companies had an objection to the vacation or relocation of the roads and utility easements, the Planning Commission unanimously recommended approval of the request and has recommended findings of fact and conclusions of law that the County Commissioners should adopt to justify approval of Ordinance #25-420. The plat amendment survey will need to be amended to provide a turnaround at the north end of Rustler Road, before recording.

Commissioner Chugg made a motion to adopt the findings and conclusions recommended by the Planning Commission and approve Ordinance #25-419. Commissioner Killian seconded the motion. Commissioner Killian voted aye, Commissioner Chugg voted aye, and Commissioner Miles voted aye. The motion passed.

Commissioner Chugg made a motion to go in and out of a closed session to discuss: pending or reasonably imminent litigation. Commissioner Killian seconded the motion. Commissioner Chugg voted aye, Commissioner Killian voted aye, and Commissioner Miles voted aye. The motion passed.
