AN ORDINANCE CREATING A LIEN ADMINISTRATIVE FEE
FOR USE BY THE DELAWARE COUNTY AUDITOR’S OFFICE
WHEREAS, the Delaware County Auditor’s Office has the responsibility of adding liens assessed on properties to those properties; and
WHEREAS, the Delaware County Auditor’s Office expends a significant amount of time processing and assessing said liens to properties; and
WHEREAS, the Delaware County Auditor, Delaware County Treasurer, and Delaware County Commissioners have engaged a third party to assist in centralizing the liens to make them more accessible to all departments and offices within Delaware County, Indiana; and
WHEREAS, the Delaware County taxpayers funds the expense of maintaining the liens in Delaware County and the cost should be borne by the property owner whose property is being liened; and
WHEREAS, it is necessary to establish a new fee structure to be assessed against the recorded owner of property against whom the lien is assessed; and
WHEREAS, it is necessary to establish a new fund in the Auditor’s Office into which the proceeds will be deposited.
NOW THEREFORE, BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF DELAWARE COUNTY, INDIANA THAT:

The Delaware County Commissioners shall create a Lien Administrative Fee for use by the Auditor’s Office, to be applied to every parcel a lien is applied to.

The fee assessed to each parcel shall be Sixty ($60.00) Dollars.

Five ($5.00) Dollars of said fee shall be payable to the Vendor processing and centralizing the liens for the County.

Fifty-Five ($55.00) Dollars of said fee shall be deposited into the Lien Administrative Fee.

3.
The Lien Administrative Fee may be used to cover any cost incurred to administer and process the liens.

All funds received by the Delaware County Auditor's Office from the Lien Administrative Fee shall be deposited into a Non-Reverting Fund #4934, Auditor’s Lien Administrative Fee Fund.
