ORDINANCE NO. 2026 – 013

WHEREAS, the Board of Commissioners are charged with protecting the health and welfare of the citizens of Delaware County; and

WHEREAS, the Board of Commissioners are obligated to review and, if necessary, amend the Street and Road Regulations of the County Highway System to allow for the more orderly and safer mode of travel on the roads; and

WHEREAS, the Board of Commissioners introduced the Ordinance on the 3rd day of August, 2026 and will conduct a public hearing on August 17, 2026 at 9:00 am with respect to a number of all way stops and speed limit changes; and

WHEREAS, the Board of Commissioners determine that certain changes will be necessary to the Delaware County Code, Title 5, Chapter 4, Street and Traffic Regulations.

THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF DELAWARE COUNTY, INDIANA, that the Delaware County Code, Title 5, Chapter 4, Street and Road Regulations shall be amended as setforth herein:

1. 1.
   Title 5, Chapter 4, Section 5, is to be amended as follows:

   A.

   There shall be an all-way stop at the intersection of Walnut Street and Fuson Road located in Center Township, Delaware County, Indiana for all traffic.
2. 2.
   The County Highway Department of Delaware County, Indiana, is hereby authorized to erect appropriate signage pursuant to the Indiana Manual on Uniform Traffic Control Devices.
3. 3.
   The penalty for violation of this ordinance shall be as herein setforth in Article XVI, Section 16-1.
4. 4.
   This ordinance shall be in full force and effect from and after its passage and publication.
