Mayor Duncan asked how close the pickleball court would be to the closest home.
Mr. Kroger confirmed that the closest property would be 138’ from the pickleball court.
Paul Bohannon, 204 Pointe Oakwood Way, shared that he is the Treasurer for the Pointe Oakwood Homeowners Association. He asked if the legal agreement between the City, Oakwood Investment Group and Hills Properties restricted uses of the top of the hill. He recalled that it was to be an office building.
Mr. Jacques explained that from a zoning standpoint what the applicant is proposing would be an accessory use that is not inconsistent with the use of that parcel as an office building. Mr. Jacques added that his recollection of the legal agreement was that it was silent on details such as a pickleball court or other accessory uses.
Garett Orlowski, 205 Pointe Oakwood Way, shared that his primary concern along with the noise is the water runoff. The Pointe Oakwood neighborhood has existing drainage issues. He asked that a water study along with a noise study be required if the project proceeds.
Mr. Kroger stated that a drainage study was completed by the Applicant and reviewed by the City Engineer.
Mayor Duncan asked if a noise study was done.
Mr. Kroger said no.
Mr. Stephens asked if the drainage study was approved.
Mr. Kroger answered yes, and said that the drainage study was reviewed and approved by the City Engineer.
Dr. Gregory Semon, 151 Pointe Oakwood Way, shared that several homes have had significant foundation issues due to drainage issues and have made significant upgrades to their drainage systems.
Mayor Duncan asked if there are still drainage issues and if so where they are located.
Dr. Semon said that they start on E. Schantz and the water just runs down the hill.
Mr. Stephens asked about the homes on the top of the hill closer to E. Schantz.
Mr. Orlowski, 205 Pointe Oakwood Way, shared that he is aware of a home at the top of the hill where water seepage damaged heated flooring. They had to install a French drain to address the water issues.
Mayor Duncan asked if the drainage is connected to the storm sewer.
Mr. Orlowski answered no.
Hamed Zolbanin, 225 Pointe Oakwood Way, shared that his home would be the second closest to the proposed pickleball court. He is the president of the Home Owners Association. He shared that even after he had a French drain installed, he still has water flowing everywhere. Mr. Zolbanin then asked how the applicant defines what a potential client is.
Marietta Orlowski, 205 Pointe Oakwood Way, said that she is concerned that the Pointe Oakwood neighborhood does not get the quality of life attention like other areas of Oakwood. She asked for the same respect that is offered to the other residents in Oakwood. She said that she supports recreation, but asked City Council to consider the impacts to the Pointe Oakwood residents.
Mayor Duncan closed the public hearing.
Mr. Kopilchack, Synergy Building Systems, shared that the entire project was created with the neighbors in mind. The applicant took time to find the best court location and court screening from neighbors. A drainage study was completed by the Applicant’s engineer and approved by the City Engineer. In regards to the definition of a potential client, Russell Total Wealth & Wellness takes a holistic approach to its services so that people can achieve and enjoy a certain lifestyle. Their goal is to allow people to experience the holistic approach before becoming a client. The court would not be open to general public use.
