Amended Interlocal Agreement

This INTERLOCAL AGREEMENT (“Agreement”) is entered into this 15^th day of June, 2026, by and between the Town of Eaton, Indiana (“Eaton”) and Delaware County, Indiana (“County”), both of which are Indiana political subdivisions and municipalities, to provide for Eaton’s purchase of road paving materials as provided in the Town of Eaton Resolution No. 2026-_______, and the County’s use of such materials and provision of all labor required to pave Crannell Drive, as provided herein.

WHEREAS, Indiana Code §36-1-7 provides for interlocal cooperation agreements between political subdivisions; and

WHEREAS, the County recently completed emergency dura patch repairs on Crannell Drive in Eaton; and

WHEREAS, that area of roadway was identified as one in need of additional repairs; and

WHEREAS, the County swept loose debris and filled potholes to improve the safety conditions of that area; and

WHEREAS, the stretch of roadway on Crannell Drive is still in need of overlay paving to improve the long-term condition of the area for Eaton, as identified in Exhibit A; and

WHEREAS, Eaton has identified two additional stretches of roadway in need of repair to improve the long-term condition of the area; and

WHEREAS, Eaton has identified Willman Road from Indiana Avenue to Eaton Town limits and Romy Street from the north approach of Bridge #27 to Indiana Avenue as the additional areas needing paved, as identified in Exhibit B and Exhibit C; and

WHEREAS, Eaton will reimburse the County for its purchase of road paving supplies necessary from the County to pave Crannell Drive and Romy Street, and the County will cover the road paving supplies necessary for Willman Road.
