on core code audits, legal compliance checks against state/federal statutes, land use adjustment tables, and annotative outlines. Stakeholder Committee Meetings: Scheduled for Tuesday, September 22; Wednesday, September 23; and Thursday, September 24, 2026. Stakeholder groups include builders/contractors, developers, design professionals (engineers, architects, planners, surveyors), realtors/brokers, economic development officials, non-profits, neighborhood associations, housing authorities, land banks, and agricultural groups.
3. Cybersecurity Alert & Website Safety Adjustments: Ms. Swackhamer alerted the board that several recent zoning/variance applicants received fraudulent scam emails soliciting online payments for rezoning and variance approvals some even falsely using her name. Staff emphasized that the DMMPC never requests fee payments via email links. To protect applicant privacy, full application packets (which contained personal phone numbers and email addresses) have been removed from the public website; going forward, only meeting agendas will be posted online.
4. BZA Hearing Officer Procedure: Ms. Swackhamer presented preliminary research regarding establishing a Hearing Officer position (designated as the Executive Director of the DMMPC) to streamline minor BZA variance petitions, as authorized under current Plan Commission Rules of Procedure. Year-to-date, Delaware County has heard 70 BZA cases (compared to 18 cases in Richmond, IN, the next highest regional municipality). While the UDO rewrite will address root causes long-term, implementing a Hearing Officer could provide immediate administrative relief.
