It was then moved by Mrs. Gowdy that Application #24-1, for proposed clarification amendments to the sign regulations of the Zoning Code, submitted by the city of Oakwood, be recommended for approval to Oakwood City Council. She added that her motion should note that the Planning Commission has considered the evidence and has reviewed the proposal for consistency with the purposes of the Zoning Code, the 2004 Comprehensive Plan, and the interests of the city of Oakwood as a whole, and finds that the same is consistent therewith. Mr. Lauterbach seconded the motion.

Mr. Aidt opened the public hearing for Application #24-2 and asked city staff to provide a report.

Mr. Kroger presented an application that was filed by David Pierce, Esq. and Sarah Sparks, Esq. from Coolidge Wall Co., L.P.A. on behalf of Insomnia Cookies requesting extended hours of operation located at 6 Oakwood Avenue, Unit C.

Insomnia Cookies seeks a new special use permit for additional late-night hours so that the retail store may remain open until 12:00 a.m., seven days a week.

The permitted operating hours in the Neighborhood Business District are 7:00 a.m. – 9:00 p.m. However, a special use permit is available for applicants seeking extended operation hours.

Insomnia Cookies currently operates under a special use permit issued in August of 2023. The permit allows retail operations until 10:00 p.m. Sunday through Thursday and until 11:00 p.m. on Fridays and Saturdays. Delivery operations may continue until 2 a.m., seven days a week. They are not requesting any change to the existing delivery hours.

Insomnia Cookies has operated with extended hours under its existing special use permit for nearly two years and city staff has received no complaints relating to the late-night hours. There are no proposed architectural changes that would impact the surrounding properties, and no material changes are proposed to the existing traffic pattern.

Mr. Aidt thanked Mr. Kroger for his presentation.

Mrs. Gowdy asked what life is like on Irving Avenue currently. She noted that many students live in the area.

Mr. Kroger shared that Irving Avenue is patrolled by the Public Safety Department frequently. He is aware of complaints related to trash and parking, but not with recent noise complaints.

Mrs. Gowdy asked if electric scooters were still ending up along Irving Avenue or in the Routsong Retail Center parking lot.

Mr. Kroger shared that there are not many instances of scooters being left at the Dayton-Oakwood border. In these events, city staff will take the scooter to the City Building until the scooter company picks it up.
