RESOLUTION 2026 – 05
DELAWARE COUNTY, INDIANA RESOLUTION APPROVING AN INTERLOCAL AGREEMENT WITH THE TOWN OF EATON, INDIANA REGARDING PAVING PORTIONS OF CRANNELL DRIVE, WILLMAN ROAD, AND ROMY STREET

WHEREAS, the Board of Commissioners of Delaware County, Indiana (the “County”) desire to assist the Town of Eaton, Indiana (the “Town”) in its efforts to improve safety and long-term maintenance of the Town’s streets by providing labor and equipment for paving portions of Crannell Drive, Willman Road, and Romy Street, to the Town; and

WHEREAS, the Town shall reimburse the Commissioners for materials necessary to complete the paving projects, as outlined in Exhibit A, Exhibit B, and Exhibit C; and

WHEREAS, the Commissioners have determined that, to provide the Town with the requested assistance, it is now necessary to enter into an Interlocal Agreement with the Town, pursuant to Indiana Code § 36-1-7-1 et seq., memorializing the terms of the parties’ agreement.

NOW THEREFORE BE IT RESOLVED, by the Board of Commissioners of Delaware County, Indiana, as follows:

1.
The Commissioners for Delaware County, Indiana hereby approve and authorize the execution of the Interlocal Agreement, attached hereto as Exhibit D, between the Board of Commissioners of Delaware County, Indiana and the Town of Eaton, Indiana.
2.
The County shall have no obligation to satisfy the terms, or any parts thereof, of the Interlocal Agreement until the Town of Eaton, Indiana adopts a substantially similar Resolution, and the Interlocal Agreement is fully executed by the parties and properly recorded as required by law.
3.
This Resolution shall be in full force and effect from the date of its passing by Commissioners for Delaware County, Indiana.

DULY ADOPTED by the Commissioners of Delaware County, Indiana at a regularly scheduled public meeting held on this, the 1st day of June, 2026.
