The operating hours permitted in the Community Business District are 7:00 a.m.- 9:00 p.m. However, a special use permit is available for businesses seeking extended operating hours.
Swoon Books & Wine seeks a new special use permit to extend its hours so that the bookstore and wine bar may remain open until 10:00 p.m. on Tuesday through Thursday, and until 11:00 p.m. on Friday and Saturday. Sunday will operate within permitted hours. Closed on Monday
Mrs. Valentin noted that several businesses in the area, including Dorothy Lane Market and the Oakwood Club, currently operate outside the hours permitted in the Community Business District. She also stated that no architectural changes are proposed that would impact surrounding properties, and no material changes to existing traffic patterns are anticipated.
Mr. Aidt opened the public hearing.
Mrs. Woodruff, the applicant, explained that they would like to mirror the Oakwood Club’s hours to give patrons the opportunity to stop by Swoon Books & Wine for drinks before and after dinner.

The Commission had no comments or questions for city staff or the applicant.
Mr. Jacques noted that, if the applicant is agreeable, he recommends amending the application to include Monday, even though the business is not currently open that day, to allow flexibility should this change in the future. The applicant agreed to the amendment.
It was then moved by Mrs. Gowdy and seconded by Mr. Byington to approve Application #26-1, requesting extended hours of operation at 2504 Far Hills Avenue, with the amendment to remain open until 10:00 p.m. Monday through Thursday and to incorporate staff findings.

The proposed use at the specified location is consistent with the Comprehensive Plan.
One of the basic principles of the Comprehensive Plan is that business areas should not adversely impact adjacent neighborhoods. The City believes extending the hours of operation as requested will not adversely impact the adjacent neighborhoods. Therefore, it is consistent with the Comprehensive Plan.
The proposed building or use will not adversely affect or change the character of the area in which it is located.
