PETITION TO VACATE AN UNIMPROVED PLATTED ALLEYS AND UNIMPROVED SECTION OF 2ND STREET IN THE COUNTY OF DELAWARE, INDIANA

Come now the Petitioners, Scott E. Smith and Carla K. Smith, husband and wife, respectfully petition the Delaware County Commissioners of Delaware County, Indiana, to vacate public alleyways and an unimproved public roadway more particularly described herein and, in support thereof state and reference the property to be vacated as follows:

That the Petitioners are the owners of the following described real estate in Delaware County, Indiana:

Lots Three (3), Four (4), Five (5) and Eight (8), also the South 58.20 feet of Lots Two (2), Six (6) and Seven (7) all in Block Four (4) in the Original Plat of Mt. Pleasant, as shown in Deed Record 2, page 356 in the records of Delaware County, Indiana

Parcel Number 18-16-19-229-002.000-020

which is more commonly known as 11610 S County Road 396 E, Muncic, IN 47302.

Laid out and Platted in Delaware County, Indiana are certain parts of public alleyways and a public roadway more specifically described as follows:

The following land description was prepared as part of a Proforma Survey by Haldon L. Ashton, LS 80040149, of Ashton Land Surveyors, Inc., per Job Number 2026182, certified April 10, 2026, being a vacation of the two 16.50 feet wide alleys and unimproved Second Street and unimproved East Street adjacent to Lots 3, 4, 5, and 8 and the South 58.20 feet of Lots 2, 6, and 7 of Block 4 in the Original Plat of Mount. Pleasant as shown by Deed Record 2, page 356, Records of Delaware County, Indiana, being more particularly described as follows:

Beginning at a 5/8 inch rebar at the Southwest corner of Lot 4 of Block 4 in the Original Plat of Mount Pleasant; thence North 66 degrees 28 minutes 07 seconds East 132.00 feet to the Southeast corner of said Lot 4; thence North 23 degrees 45 minutes 19 seconds West 132.00 feet to the Northeast corner of Lot 3 of said Block 4; thence South 66 degrees 28 minutes 07 seconds West 132.00 feet to the Northwest corner of said Lot 3; thence North 23 degrees 45 minutes 19 seconds West 16.50 feet to the Southwest corner of Lot 2 of said Block 4; thence North 66 degrees 28 minutes 07 seconds East 132.00 feet to the Southeast corner of Lot 2; thence North 23 degrees 45 minutes 19 seconds West 58.20 feet; thence North 66 degrees 28 minutes 07 seconds East 16.50 feet to the West line of Lot 6 of Block
