3.    That this alleyway and roadway to be vacated shall not effect the rights of any and all public utilities to gain entry, to construct, add to, maintain, replace and renew any facilities which are now located in the area being vacated with the same rights with respect to said facilities as if the vacation proceeding had not been made.
4.    That the Vacation area is unimproved.
5.    That the following named individuals own real estate which directly abuts the alleyways and unimproved roadway being proposed to be vacated:

Dean Peercy and Betty Peercy, who reside at 11700 S County Road 396 E, Muncie, IN 47302.

Eric G. Hopper and Jayne E. Hopper, who reside at 11501 S. US 35, Muncie, IN 47302

Larry Randal and Tomasa Spalding, who reside at 11517 US 35, Muncie, Indiana 47302

Shad A Peters, who resides at 1600 S County Road 396 E., Muncie, Indiana 47302

6.    That the vacation of the above described undeveloped alleyways and unimproved roadway will not hinder the growth or orderly development of the neighborhood in which it is located or to which it is contiguous; that the vacation will not make access to the lands of any person by means of a public way difficult or inconvenient; that the vacation of this alleyway will not hinder the public access to a church, school, or other public building or place; and that the vacation will not hinder the use of a public way by the neighborhood in which it is located or to which it is contiguous.
