Mr. Hamilton stated Abe Wright contacted me. He is working on a ditch in Salem Township. There is a tributary of the Pate Shoemaker regulated drain that passes through a field. This tributary shows up as a regulated drain on the 1887 map, but it's not currently indicated on our list of regulated drains. I asked the surveyor to look into this to decide whether this regulated drain had been abandoned or just lost. Dennis Nixon farmed some of the ground and they are interested in converting this from a mutual drain into a regulated drain similar to what we did on the regulated drain on 700 East if it is not currently a regulated drain. I went through some of that with him this week and I will work with the surveyor to go through this process. David Howell, 261 South County Road 600 West, Middletown. We farm from 600 going west to where Mr. Nixon farms, and that's the field that they're trying to get ready to drain. In fact, they've got tile in it. Abram's been working out the problems with the rest. it's a mess. I mean, a mess physically and legally. Mr. Hamilton stated I will work with you, Mr. Nixon and Mr. Wright to come up with a solution for this problem. Mr. Howell, Thank you.

Ms. Riggin stated I think it would be fair to say that the Drainage Board is not willing to pay for incomplete projects and maybe deduct a couple thousand for these projects. Just give them some warning if they are not up to snuff, they could be delayed and not paid their full amount. Mr. Borchers stated I can let them no. Ms. Riggin, thank you.

Executive Session:

Mr. Christy stated Mr. President, I'd like to see the drainage board set a time for an executive session. I understand in speaking with our legal folks that it is possible for us to have an executive session about certain things. We do have to do a Forty-eight-hour notice. I would like to see that happen. Mr. Hamilton stated do you have a time and date in mind? Mr. Christy stated probably with the February meeting, before or after. Mr. Whitehead stated okay, 10 a.m. February 11, executive session. Does that need a motion? Mr. Brookes stated no. As long as the chair is in agreement and the board has a consensus then you can set an executive session. Mr. Borchers asked would you like me to see if the room downstairs is open? That way we do not have to stream it. Mr. Whitehead stated I was under the impression anything held in this room had to be streamed. Mr. Brookes stated generally that’s the case for public meetings but this isn’t a public meeting. Mr. Borchers stated I will make sure this room is available after our public meeting.
