Mr. Bohachek asked Mr. Jacques to administer an oath to those who wished to testify.
Mr. Jacques proceeded to swear in the applicant, Jonathan Riedel, who was the only visitor who planned to testify.
Mr. Bohachek then asked Mr. Kroger to present a staff report before opening the public hearing.
Mr. Kroger referenced a PowerPoint presentation and provided the following information.
Application #24-1 was filed by Jonathan Riedel to vary the side and rear yard setback for an attached two-car garage at 42 Forrer Road. The property is located in the R-3 (single-family) Zoning District which is intended to preserve those residential areas which are best suited for large-sized lot development and to maintain the character of existing low-density, single-family developments. The R-3 zoning district requires a 10-foot side yard setback and a 40-foot rear yard setback for building additions to be added to the primary structure.
The home is legally non-conforming and has a current rear setback of 25’. The side yard setback is conforming and has a setback of 30’ where 10’ is required. The Applicant’s proposal involves adding a new attached two-car garage. This would require a variance that would change the side yard setback by approximately 3 feet, reducing it from 10 feet to approximately 7 feet. The 25’ non-conforming rear yard setback is grandfathered; the variance request would be measured from that point. This proposal would result in a setback of 14’ for the rear yard where 25’ is required, for a difference of 11’.
Mr. Kroger displayed the proposed site plan, a rendering of the property, and an image of the home from the street.
Mr. Kroger closed his presentation by stating that if the Board of Zoning Appeals is inclined to grant this setback variance, staff requests that the Board impose the following conditions:
- The property owner must obtain appropriate permits through the city of Kettering.
- Any drainage pattern disruption resulting from the installation of the garage must be addressed by the applicants so that there is no resulting negative effect on neighboring or city-owned property.
- Trench drain to be installed and inspected per Oakwood rules and regulations.
Mr. Endsley asked if the neighbors were notified of this public hearing.
Mr. Kroger explained that a notification letter was sent to neighbors within 200 feet of the subject property and a legal notice was placed in the Oakwood Register. None were in attendance.

Mr. Riedel, Applicant, 42 Forrer Road, shared that he is a lifelong Oakwood resident. His house was built in 1941 with a side entry garage that is non-conforming. The driveway layout creates almost a 14-point turn to get cars in the garage. Several designs were considered and the proposed attached garage is the most conforming design while still being functional. The design will match the appearance of the house.
Mr. Endsley asked why the garage couldn’t be flush with the back line of the house.
