layout. The proposed garage will be 10’ from the back-property line. The plan is to use half of the existing garage for a mud room leading to the kitchen. The current side door would be moved 4-6’ and become a natural entry into the mud room.

Mr. Endsley asked about the width of the proposed garage.

Mr. Riedel shared that the dimensions would be 24’ x 24’ which is a standard two-car garage.

Mr. Bohachek asked what the existing garage will be converted into.

Mr. Riedel explained that the existing garage would be converted into a living space and the other side would be used for storage and a mud room.

Mrs. Weprin noted that the driveway already goes into the backyard.

Mr. Riedel explained that this is how the driveway was built.

Mr. Bohachek asked if the retaining wall in the back would be removed and re-landscaped.

Mr. Riedel answered yes. The east and rear foundation walls will roughly be the same height as the existing retaining wall, so the structure will be nestled into the hillside.

Mr. Endsley asked if the area behind the existing driveway is completely wooded.

Mr. Riedel shared that the area is not completely wooded. Several mature trees will remain. There is also some landscaping between the rear neighbors and his property.

Mr. Bohachek closed the public hearing and the Board began their deliberations.

Mr. Bohachek shared that 24’ x 24’ is a standard-size garage. The proposed garage could not be moved further forward because it would interfere with the intent to retain the side entry door.

Mr. Hill noted that he does not have concerns with the application as presented. There is a provision in the Oakwood Zoning Code giving a five-foot allowance if there is an accessory structure that is completely behind the footprint of the existing primary structure.

Mr. Endsley proposed imposing more screening so the adjoining property doesn’t look like it is abutting the garage.

Mr. Hill commented that he doesn’t believe this is necessary due to space and he prefers to let the applicant work out the screening details.

Mrs. Weprin asked if city staff received any questions from the neighbors.

Mr. Kroger noted that he spoke with surrounding neighbors to answer a few questions about the application but legally he is not able to give their testimony since they are not at the meeting to testify. He noted they did not feel it was necessary to attend.

Therefore, it was moved by Mr. Hill and seconded by Mrs. Weprin that the staff findings be adopted and application #24-1, a request by Jonathan Riedel the side and rear yard setback for an attached two-car garage at 42 Forrer Road be approved with the following conditions:

  1. The property owner must obtain appropriate permits through the city of Kettering.
