AN ORDINANCE

TO ENACT NEW CHAPTER 909, PROGRAMMED WORK ZONES, OF THE STREETS AND PUBLIC SERVICES CODE.

WHEREAS, each year, Council authorizes and the City Manager implements a program to construct, repair, improve, and/or maintain sidewalks, curbs, gutters, and appurtenances thereto within various areas of the City (the “Sidewalk, Curb, and Apron Project,” also known as the “SCA Project”); and

WHEREAS, in order to assess costs for the SCA Project, Council must adopt several legislative enactments in order to meet statutory requirements, each of which requires a description of the specific streets and termini involved in the project; and

WHEREAS, due to the programmed nature of the SCA Project, which rotates through all areas of the City over a period of years, the City Engineer has recommended that Council describe the specific streets and termini by establishing defined work zones throughout the City, which will provide greater administrative efficiency for project planning, budgeting, and the preparation of statutory legislation;

WHEREAS, similar statutory requirements apply for other public improvement projects that may involve the assessment of costs under Chapters 728 or 729 of the Ohio Revised Code, which can realize the same efficiencies by utilizing a system of defined work zones; and

WHEREAS, Council finds that the City Engineer’s recommendation is well taken, and will promote administrative efficiency and benefit the general welfare of the citizens of Oakwood, and desires to implement the same;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OAKWOOD, STATE OF OHIO, THAT:

SECTION I. New Chapter 909, Programmed Work Zones, and a new Appendix B, both of the Streets and Public Services Code, as set forth on the attached exhibit and incorporated herein by this reference, are hereby adopted and made a part of the Codified Ordinances of the city of Oakwood, Ohio.

SECTION II. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all deliberations of Council and any of its committees that resulted in that formal action were in meetings open to the public to the extent required by law.

SECTION III. This ordinance shall take effect as of the earliest date permitted by law.
