INTERLOCAL AGREEMENT BETWEEN DELAWARE COUNTY, INDIANA AND COWAN COMMUNITY SCHOOL CORPORATION FOR THE LABOR AND PAVING OF PORTIONS OF DRIVES SURROUNDING COWAN HIGH SCHOOL AND ELEMENTARY SCHOOL AND THE MONROE TOWNSHIP VOLUNTEER FIRE DEPARTMENT PARKING LOT

This INTERLOCAL AGREEMENT (“Agreement”) is entered into this 20 day of July, 2026, by and between the Cowan Community School Corporation (“Cowan”) and Delaware County, Indiana (“County”), to provide for Cowan’s purchase of road paving materials and the County’s use of such materials and provision of all labor required to pave portions of roads surrounding Cowan High School, Cowan Elementary School, and the Monroe Township Volunteer Fire Department parking lot, as provided herein.

WHEREAS, Indiana Code §36-1-7 provides for interlocal cooperation agreements between the parties; and

WHEREAS, the County and Cowan enter into this Interlocal Agreement with one another; and

WHEREAS, the County is an Indiana political subdivision; and

WHEREAS, Cowan desires to obtain services from County by way of the use of equipment and labor; and

WHEREAS, the areas identified as Exhibit A are in need of repairs; and

WHEREAS, the parties hereto recognize that it is in the best interests of the citizens within their respective jurisdictions and in the furtherance of the safety and welfare of the citizens to have the section of the road resurfaced from the east side of the high school starting at Nottingham Street to the point it Cowan property begins. The work will proceed in the “drop off” lane in front of Cowan High School, the auxiliary gym, and administration office, behind Cowan Elementary School. The paving will continue along the drop off lane to the west of Cowan Elementary School. It will also include the area from the Monroe Township Fire Station to Olive Street.; and

WHEREAS, the governing body of each party has resolved, agreed, or ordained that this Interlocal Agreement may be entered into;

NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is hereby agreed as follows:

1. Duration. This Agreement shall be in force from its Effective Date, defined above, until terminated as provided below.

2. Purpose. The purpose of this Agreement is for Cowan and the County to mutually agree for Cowan to purchase and provide all road paving material necessary at the County’s cost for the County to pave and provide labor to complete the project outlined in Exhibit A.
