MINUTES

The Council of the city of Oakwood, Ohio, met in a work session on Monday, March 20, 2017 in the conference room of the Oakwood Municipal Building, 30 Park Avenue. The Mayor of the city, William Duncan, presided.

Mayor Duncan called the meeting to order at 4:45 p.m. At this time, Council members in attendance were Mayor William Duncan, Councilmember Rob Stephens and Councilmember Chris Epley. Staff in attendance were City Manager Norbert Klopsch and City Attorney Rob Jacques. Attorney Ned Dowd also attended the meeting at this time. Mayor Duncan opened an executive session for conference with attorney.

At 4:56 p.m., Mayor Duncan concluded the executive session for conference with attorney at which time Mr. Dowd departed the meeting and Council moved to a special regular session where Vice Mayor Steve Byington and Councilmember Anne Hilton joined the meeting (minutes for the regular session are separately journalized and not set forth here.)

At 5:30 p.m., Mayor Duncan called the work session back to order. Mayor Duncan then led a discussion on the following agenda items:

• COUNCIL COMMITTEES
  • Finance, Vice Mayor Byington
    • Income Tax Collection: Mr. Klopsch noted that income tax collections for 2017 year-to-date are significantly below 2016, but this is to be expected given the negative impact of HB 5, and Dayton and Centerville raising their tax rates. The total impact of these actions will not be fully realized until later this year.
  • Planning & Zoning, Vice Mayor Byington
    • “Small Cell” Antennas and SB 331: Mr. Klopsch and Mr. Jacques provided an update on the legal action being taken by 49 communities from central and southwest Ohio. This legal action is opposing SB 331, primarily on the grounds that it violates the One Subject Rule in the Ohio Constitution, and it violates the city’s Home Rule authority, also in the Ohio Constitution.
  • Public Properties, Mr. Epley
    • Schenck and Oakwood Pocket Park: Mr. Klopsch reported that staff is finalizing plans to submit a grant application to the Montgomery County Solid Waste District Incentive Grant Program to help fund improvements to the Schenck and Oakwood Pocket Park.
  • Public Utilities/Waterworks/Sewer, Mr. Epley
    • Water Service Lines: Mr. Klopsch provided an overview on the new Ohio EPA requirements for Public Water Systems to create maps depicting areas within their systems where lead-containing water pipes or fixtures may be present.

At 6 p.m., Ohio Representative Jim Butler joined the meeting. Representative Butler briefed Council on the proposed 2018/19 State Budget and other legislation pending or under consideration at the Ohio State House. This discussion concluded at 6:50 p.m. at which time Representative Butler departed the meeting and Council continued the work session discussion.
