District has a 25-foot front yard setback and a 6-foot interior side yard setback requirement. The configuration of this lot is consistent with the R-4 Zoning District and does not look out of place.

Should the Board of Zoning Appeals be inclined to approve all or any part of this application, staff recommends the following conditions:

  1. The property owner must obtain appropriate permits through the city of Kettering.
  2. Any drainage pattern disruption resulting from the installation of the porch must be addressed by the applicants so that there is no resulting negative effect on neighboring or city-owned property.

Mr. Endsley asked what the front yard setback is in the adjacent R-4 Zoning District.

Mr. Kroger and Mr. Kavanaugh answered that it is 25 feet.

Mr. Endsley thanked Mr. Kroger for his presentation and opened the public hearing. He then asked Mr. Jacques to administer an oath to those who wished to testify.

Mr. Jacques proceeded to swear in the applicant, George Kordalis, who was the only visitor who planned to testify.

Mr. Kordalis, Applicant, 825 Harman Road, shared that he thought a porch would be a nice addition to the home.

Mr. Endsley closed the public hearing and the Board began their deliberations.

Ms. Yankel shared that she does not have any concerns or questions about the application.

Mr. Kavanaugh agreed. He believes it falls within the spirit of the neighborhood.

Mr. Endsley noted that this is a fairly straightforward application. The home appears to be better suited in the R-4 Zoning District. The proposed addition enhances the property and he is comfortable approving the application.

Therefore, it was moved by Mr. Kavanaugh and seconded by Ms. Yankel that the staff findings be adopted and application #24-2, a request by George Kordalis to vary the front yard setback in conjunction with a covered porch structure to be added onto the existing single-family residence located at 825 Harman Avenue be approved by viva voce vote with the following conditions:

  1. The property owner must obtain appropriate permits through the city of Kettering.
  2. Any drainage pattern disruption resulting from the installation of the porch must be addressed by the applicants so that there is no resulting negative effect on neighboring or city-owned property.
