DELAWARE COUNTY COMMISSIONERS

AN ORDINANCE RESCINDING ORDINANCES 2014-040A AND 2013-003 AND DEFINING INSURANCE FOR DELAWARE COUNTY RETIREES AND REMOVING SPOUSES AND DEPENDENTS FROM COVERAGE

WHEREAS, Ordinance 2013-003 “Ordinance Defining Insurance for Delaware County Retirees” was adopted on or about April 1, 2013, and included, but was not limited to, eligibility requirements for retirement insurance coverage; and

WHEREAS, Ordinance 2014-040A “An Ordinance Amending Ordinance 2013-003 Ordinance Defining Insurance for Delaware County Retirees” was adopted on or about December 15, 2014, and modified the continuous years of service required for elected officials to qualify for retiree insurance coverage from ten (10) years to eight (8) years due to statutory constraints on terms of service; and

WHEREAS, the Delaware County Commissioners have made changes to the retirees insurance benefits, effective January 1, 2026, including the elimination of spouses and dependents from coverage; and

WHEREAS, it is necessary to rescind Ordinances 2014-040A and 2013-003 and create this Ordinance to define the new parameters for retirees insurance benefits.

NOW THEREFORE, BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF DELAWARE COUNTY, INDIANA THAT:

  1. The Retiree Health Insurance Plan (the Plan) shall be adopted as agreed to by the Delaware County Board of Commissioners and the contract with the Health Insurance Provider. Any rights retirees may have under those benefits controlled by Plan Documents are created solely by the written document, which the Plan Sponsor has adopted, and which retirees may examine upon request. In the event there are any conflicts between the summary and the respective Plan Document, the Plan Document shall control.
  2. Application for coverage as a retiree shall be made prior to termination of employment. Employees wishing to participate in the Retiree Insurance program should contact Human Resources to determine eligibility for the employee.
