There shall be a minimum setback from any septic tank and tile disposal field of at least 50 feet.
Natural drainage courses encountered during the construction or enlargement of a pond shall not be altered in any way that would cause them to no longer function. Adherence to IC 36-9-27.4 will be maintained.
No pond shall be constructed or enlarged in a manner that causes pond overflow water to run off onto adjacent lots, parcels or roadways. Pond will be constructed 75 feet from right of way and 50 feet from the property line.
Discharge of water from a natural or artificial pond shall be controlled through the engineering of an outlet to an appropriate waterway or County Legal Drain with Drainage Board approval. Compliance with this provision shall not relieve the owner from any additional duties under Indiana law with respect to the discharge of such water onto an adjoining property or roadway.
No pond shall be located directly beneath an overhead electrical line, wire, conductor, or within 25 feet horizontally of any overhead electrical or utility lines.
No pond shall be constructed within 75 feet of any type of utility easement, private field tile, or County Legal Drain setback.
Pond construction and excavation that will disturb over one acre of ground shall obtain a Stormwater Pollution Prevention Plan approval from the Stormwater Management Office and an IDEM Construction Stormwater General Permit. All work shall be done in a manner that complies with these requirements and strives to protect the property and adjoining properties against soil erosion.
Ponds less than one acre in disturbance must prevent discharge of pollutants, such as sediment and trash, onto adjacent properties in accordance with the local Stormwater Management Ordinance Section 2.
It is strongly recommended that the applicant contact the Natural Resources Conservation District for guidance in planning and constructing a pond.
The pond shall be located and properly graded so as to prevent sewage or runoff from barnyards from draining into the pond.
No permit shall be issued for wetlands or floodways until any required State of Indiana permits from the Department of Natural Resources have been acquired.
Approval by the Delaware County Drainage Board may be required if reviewing officials determine it is necessary to ensure that work will not negatively impact drainage patterns both on and off site.
All approved ponds shall be completed within one year of the issuance of permit. One six-month extension shall be granted if the applicant shows that substantial progress is being made.
To discourage ponds from becoming a breeding ground for mosquitoes, all ponds should be designed to maintain a minimum depth of 6 feet, or as recommended by the most current
