Being a public hearing on the matter of an application requesting a variance of use from the terms of the Delaware County Comprehensive Zoning Ordinance, to allow the operation of a machine shop and race car engine business on site, in a farming zone, on premises located at 9690 North County Road 500 West, Harrison Township, Delaware County, Indiana, as more accurately described in the application.

  • Applicant Testimony: Evan Jackson seeks to consolidate his business onto his family’s 80-acre farm. He explained that engine testing (dyno) occurs at most once a week between 10:00 A.M. and 4:00 P.M. He is working on soundproofing but noted financial constraints after a tornado destroyed his previous shop.
  • Public Comment: Adjoining neighbor Fred Beehler spoke in favor, noting the property is clean and the noise is not disturbing to him. Neighbor Robert Haines spoke in opposition, stating the dyno testing is extremely loud and disruptive to his livestock and dogs. Ms. Swackhamer noted an email in opposition from Elizabeth Dargo.
  • Board Discussion: The Board discussed limiting testing hours and durations to mitigate neighbor concerns.
  • Action: Steven Hinds moved to approve with the conditions that 1) The variance be for the applicant only, 2) That (dyno) testing shall only take place Monday-Friday between 9:00 am and 4:00 pm, and 3) That no single test cycle shall exceed 15 minutes. Richard Ivy seconded.
  • Vote: Approved 4-2 (Billington, Fritch: No).
