OAKWOOD BOARD OF HEALTH
RESOLUTION

NO.  19-2
TO ADOPT AN ISOLATION AND QUARANTINE POLICY FOR INFECTIOUS DISEASES
AND OTHER PUBLIC HEALTH EMERGENCIES

WHEREAS, the Oakwood Board of Health has primary authority to enforce the provisions of Ohio Revised Code (“ORC”) Sections 3707.04 to 3707.34 regarding quarantine and isolation; and

WHEREAS, ORC Section 3707.04 authorizes the Health Commissioner to act on behalf of the Board of Health in administering the provisions of ORC Sections 3707.04 to 3707.34 regarding quarantine and isolation, if the Health Commissioner acts pursuant to a policy adopted by the Board and approved by Oakwood City Council; and

WHEREAS, by enacting this Resolution, it is the intent of the Board to enact such a policy; and

WHEREAS, the Board specifically finds that this Resolution is necessary for the protection of the public health, safety, and welfare in the event of an outbreak of infectious disease or other public health emergency;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF HEALTH OF THE CITY OF OAKWOOD, MONTGOMERY COUNTY, OHIO, THAT:

Section I.
The foregoing recitals are hereby incorporated by this reference.
Section II.
The Oakwood Board of Health hereby adopts the “Isolation and Quarantine Policy for Infectious Diseases and Other Public Health Emergencies” set forth on the attached Exhibit A, which is incorporated by this reference, provided however that the Health Commissioner shall have no authority to act thereunder unless and until the same shall be approved by Oakwood City Council.
Section III.
The Board Secretary is hereby authorized and directed to transmit a copy of Exhibit A to the Oakwood City Council for its review and approval, as required by ORC Section 3707.34(B), and to attach a certified copy of such approval to this policy upon receipt.
Section IV.
This resolution shall take effect as of the earliest date permitted by law.
