WHEREAS, Scott E. Smith and Carla K. Smith, filed this petition with the Board of Commissioners of Delaware County, Indiana, to vacate a part of a public way, more specifically described as follows:

Parcel A

A vacation of the two 16.50 feet wide alleys and unimproved Second Street and unimproved East Street adjacent to Lots 3, 4, 5, and 8 and the South 58.20 feet of Lots 2, 6, and 7 of Block 4 in the Original Plat of Mount Pleasant as shown by Deed Record 2, page 356, Records of Delaware County, Indiana, being more particularly described as follows:
