A vacation of the South Half of unimproved Second Street at the North side of Lots 1, 6 and 7 of Block 3 in the Original Plat of Mount Pleasant, a Town as shown by Deed Record 2, page 356, Records of Delaware County, Indiana, being more particularly described as follows:
Beginning at a point on the East line of Main Street in the Town of Mount Pleasant, said point being South 23 degrees 45 minutes 19 seconds East 24.75 feet (assumed bearing) from a 5/8 inch rebar at the Southwest corner of Lot 4 of Block 4 in the Original Plat of Mount Pleasant; thence North 66 degrees 28 minutes 07 seconds East 313.50 feet along the centerline of Second Street extended to the Easterly line of East Street; thence South 23 degrees 45 minutes 19 seconds East 24.75 feet; thence South 66 degrees 28 minutes 07 seconds West 313.50 feet along the South line of said Second Street; thence North 23 degrees 45 minutes 19 seconds West 24.75 feet along the East line of Main Street to the point of beginning.

Beginning at a 5/8 inch rebar on the Northerly line of Second Street, said rebar being North 66 degrees 28 minutes 07 seconds East 16.50 feet (assumed bearing) from the Southeast corner of Lot 8 of Block 4 in the Original Plat of Mount Pleasant a Town as shown by the Records of Delaware County, Indiana; thence North 23 degrees 45 minutes 19 seconds West 206.70 feet to a 5/8 inch rebar; thence North 66 degrees 28 minutes 07 seconds East 16.50 feet; thence South 23 degrees 45 minutes 19 seconds East 231.45 feet along the East line of East Street; thence South 66 degrees 28 minutes 07 seconds West 16.50 feet; thence North 23 degrees 45 minutes 19 seconds West 24.75 feet to the point of beginning.
WHEREAS, that this segment of 2nd Street is platted as a public way but it was never paved, improved or otherwise developed;
WHEREAS, Scott E. Smith and Carla K. Smith are the owners of Lots Three (3), Four (4), Five (5) and Eight (8), also the South 58.20 feet of Lots Two (2), Six (6) and Seven (7) all in Block Four in the Original Plat of Mt. Pleasant, as shown in Deed Records 2, page 356 in the records of Delaware County, Indiana.
