Commissioner Chugg made a motion to enter a public hearing. Commissioner Killian seconded the motion. Commissioner Chugg voted aye, Commissioner Killian voted aye, and Commissioner Miles voted aye. The motion passed.

Deputy Attorney Grant Charles explained the ordinance and that the dollar amounts are just placeholders. The fees will be updated during a public hearing for the County Fee Schedule. The road department will need to determine the cost to process the permit. Blanket Bonds will be accepted as previously discussed during the last public hearing.

Rikki Hrenko-Browning with the Utah Petroleum Association (UPA) asked about the bond timeline. The language contradicts itself, as it says two weeks, ninety days, and six months. She also asked about the three different amounts for blanket bonds. The parties discussed the bonds and when they would be called. She also asked about an appeal process. The Ordinance or permit application does not define that process. The parties discussed the appeal process.

Jake Woodland commented on the blanket bond and suggested removing it from Class D roads. The parties discussed the County’s interest in the Class D Roads and the need to retain the bond for protection. The roads have to be kept open.

Commissioner Miles commented on the claims to bonds. He suggested sticking with 90 days for repairs instead of 6 months, in case any issues arise.

Zane Lay said the proposed ordinance would require oil companies to obtain a permit for Class D roads where permits weren’t required previously.

The parties discussed the potential to add a permit requirement for all roads, including Class D roads, for crossing, and to add an appeal process to the Ordinance. Public Works Deputy Director Clint Curtis said the road department has not seen any damage issues on Class D roads in the past.
