Discussion & Consideration of the WOTUS Comment Letter
Community Development Director Mike Hyde presented a three-page letter addressed to the U.S. Environmental Protection Agency's Office of Water, regarding the definition of “Waters of the United States” under the Clean Water Act. He explained that the Utah Association of Counties (UAC) encouraged the counties to weigh in on the federalism consultation regarding the forthcoming rulemaking to revise the definition of “waters of the United States” (WOTUS). Duchesne County doesn’t want Federal Regulations on waters that are not navigable. The irrigation ditches, or man-made infrastructure, shouldn’t be controlled by federal regulations. The parties discussed the letter. Commissioner Chugg made a motion to approve and send the letter prepared by Mike Hyde as presented. Commissioner Killian seconded the motion. Commissioner Chugg voted aye, Commissioner Killian voted aye, and Commissioner Miles voted aye. The motion passed.
Discussion & Consideration of Nominees for the Uintah Basin Medical Nominating Committee
Commissioner Chugg suggested three individuals' names for the nominating committee for the Uintah Basin Medical Board of Health. Kent Peatross, Ken Burdick, and Eileen Jensen are the three names to be sent to the nominating committee. The parties discussed the board and the individual's previous service and experience. Commissioner Chugg made a motion to submit these names to the UBH nominating committee. Commissioner Killian seconded the motion. Commissioner Chugg voted aye, Commissioner Killian voted aye, and Commissioner Miles voted aye. The motion passed.
Discussion & Consideration of Ordinance 25-421; An Ordinance Prohibiting the Use of Engine Brakes Where Posted and Amending the Duchesne County Code
Attorney Intern Daniel Beales presented Ordinance 25-421; An Ordinance Prohibiting the Use of Engine Brakes Where Posted and amending the Duchesne County Code, and explained its purpose. The parties discussed the requirement for mufflers, allowing for emergency use, and the areas of the County that need noise restrictions. Some changes need to be made. This item will be discussed at the next Commission meeting.
Discussion of Amending Policy 401: Purchasing Card
Attorney Intern Daniel Beales presented the updated policy. The parties discussed some changes to the purchasing card policy, including the addition of a committee to review issues before the purchasing card is deactivated or removed from the employee. The department head should also be involved in the discussion. Commissioner Killian made a motion to approve the updates to Policy 401: Purchasing Card. Commissioner Chugg seconded the motion. Commissioner Killian voted aye, Commissioner Chugg voted aye, and Commissioner Miles voted aye. The motion passed.
Discussion & Consideration of a Nest Predator Bounty Program
Attorney Intern Daniel Beales presented the terms and conditions of the Duchesne County Nest Predator Bounty Program. He explained that the program's purpose is to increase the pheasant population. The parties discussed the program and the predators that would be included in it. The Commissioners would like to have a conversation with other entities, such as UDAF, WCF, and the DWR, about the program.
