Ms. Vannice stated that that some of the house and other structures had been built before the current zoning was in place and even before there were building permits. She stated that there were more problems to the south and across the street, but that they were only doing this portion. She stated that if they had done the entire area, it would have been difficult contacting everyone and that there was a cemetery in the area that had plots in some of those streets.
Mr. LaChat asked if Ms. Vannice lived in the area or if she had been hired to do this work.
Ms. Vannice stated that she was familiar with the area but that she had been hired.
No one appeared in opposition.
Mr. Brand asked if this would be a motion to approve or disapprove of the request.
Ms. Swackhamer stated yes.
Mr. Brand stated that he looked up IC 36-7-3-12, and asked for clarification if this was what gave this Board the authority to approve this type of request.
Mr. Wiseley stated that the reason the Board had jurisdiction over this matter rather than the County Commissioners was that they were vacating the entire plat, not just the streets and alleys which had never been improved. He stated that the last time that this body had a similar request was when part of Lane Crest had been vacated to build what was now the Campus Crest apartments on McGalliard Road and Oakwood Avenue.
Mr. Brand made a motion to approve MPC 03-26A. Mr. Dishman seconded the motion. Voting in favor: Mr. Brand, Mr. Carroll, Mr. Dishman, Mr. Ivy, Mr. LaChat, Mr. Landess, Ms. Sipe, and Mr. Smith. Voting against: None. Motion carried, MPC 03-26A approved.

Being a consideration of an appeal filed by Hunter Family Irrevocable Grantor Trust & Honey Rock Farms, 6915 East County Road 550 South, Muncie, Indiana, requesting a change in zone from the split zoning of R-3 Residence Zone and F Farming Zone to the F Farming Zone at the premises of 12049 South County Road 349 East, and the R-3 Residence Zone to the F Farming Zone on premises located at 11721 South County Road 396 East, both in Muncie, Indiana , as more accurately described in the application.
Kathy Vannice, Ashton Land Surveyor, 325 West Washington Street, Muncie, Indiana, appeared to represent the applicant. She stated that after vacating the plat the goal was to combine parcels and that due to the split zoning, they were correcting that issue. She stated that the property had a barn in the middle of a street with an old house nearby, and if they tore that down they would have an accessory structure without a primary dwelling so they were trying to correct those issues.
