A RESOLUTION AMENDING THE ENFORCEMENT POLICY
PREVIOUSLY ADOPTED VIA RESOLUTION 25-2.

WHEREAS, on November 18, 2024, pursuant to Section 3717.11 of the Ohio Revised Code, the Ohio Department of Agriculture (ODA) conducted a survey of the Board’s Retail Food Establishment (RFE) program, which is operated through a contractual relationship with Public Health – Dayton & Montgomery County (PHDMC); and

WHEREAS, the ODA determined that the Board’s RFE program is performing in a satisfactory manner, in substantial compliance with applicable provisions of the Ohio Revised Code and Ohio Administrative Code, but nevertheless required the Board to approve and submit an action plan pertaining to certain items in the survey; and

WHEREAS, among those items was the adoption of PHDMC’s Enforcement Procedure policy, which has been updated since Resolution 25-2 was adopted; and

WHEREAS, the Board desires to adopt PHDMC’s updated Enforcement Procedure policy as its own;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF HEALTH OF THE CITY OF OAKWOOD, MONTGOMERY COUNTY, OHIO, THAT:

Section I.

In support of the Action Plan previously approved by the Oakwood Board of Health, the Board hereby approves and adopts the updated Enforcement Procedure policy attached hereto as Exhibit A, which is incorporated by this reference and supersedes the Enforcement Procedure policy previously adopted via Resolution 25-2.

Section III.

This resolution shall take effect upon passage. The Secretary is authorized and directed to transmit a copy hereof to the appropriate office(s) of the Ohio Department of Agriculture as may be required.
