Oakwood Board of Health

WHEREAS the Oakwood Board of Health is approved under Section 3717.11 of the Revised Code to serve as licensor of retail food establishments and food service operations within its jurisdiction; and

WHEREAS the Board, as licensor, is authorized to inspect retail food establishments or food service operations to determine compliance with Chapter 3717 of the Revised Code and rules adopted under it or investigating a complaint regarding foodborne disease; and

WHEREAS except in a case of violation that presents an immediate danger to the public health, before initiating action to suspend or revoke a retail food establishment or food service operation license, Section 3717.29(C)(1) and Section 3717.49(B)(1) of the Revised Code requires that the Board of Health shall give the license holder written notice specifying each violation and a reasonable time within which the license holder must correct each violation to avoid suspension or revocation of the license; and

WHEREAS if the license holder fails to correct the violation in the time granted by the Board, the Board may initiate action to suspend or revoke the retail food establishment or food service license by giving the license holder written notice of the proposed suspension or revocation, with a description of the procedure for appealing the proposed suspension or revocation included in the notice; and

WHEREAS a Health Commissioner or other person employed by the Board, if the Health Commissioner or other person employed by the board is authorized by the board to take the action, may take any action that the board may take under Section 3717.29(C)(1) and Section 3717.49(B)(1) of the Revised Code.;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF OAKWOOD, MONTGOMERY COUNTY, OHIO, BOARD OF HEALTH THAT:
