application was heard by the Planning Commission on September 4, 2024 and by a vote of 4-0, with one member recusing himself, was recommended approval to City Council with conditions.
On October 7, 2024, City Council conducted a public hearing and heard from several of the neighbors from the Pointe Oakwood neighborhood who opposed the application. Due to questions about neighbor notification, Council was concerned that the Planning Commission may not have had a full opportunity to hear from the neighbors in fashioning its recommendation. As a result, City Council denied the application but expressly authorized the Applicant to refile to ensure a prompt resolution.
Mr. Kroger shared that the proposed pickleball court will be located on the south side of the property between the existing building and W. Schantz Avenue. The pickleball court will be located approximately 76 feet from the public right-of-way on W. Schantz Avenue and approximately 138 feet from the east property line bordering the homes in Pointe Oakwood. The proposed pickleball court will be roughly 880 square feet, which is standard pickleball court size, however, the overall surface will be 1,800 square feet to allow for baselines and sidelines. The court will be completely enclosed with a 10' high chain link fence and heavily screened with vegetation to obstruct the view from neighboring businesses and residential properties. The pickleball court will also feature lighting to illuminate the court. The lighting will be mounted to four poles located within the fencing surrounding the pickleball court.
When originally heard on September 4, 2024, the Planning Commission voted 4-0, with one member recusing himself, to recommend approval to City Council on the following conditions:
- Hours of operation are from 9 a.m. to 8 p.m.;
- The Applicant must work with city staff to develop a lighting plan that ensures lighting is no taller than 12’ and timer-controlled; and
- The Applicant must restrict use of the pickleball court to RTWW employees, clients, and prospective clients.
Mr. Hill asked if there were any material changes from what was presented to the Planning Commission in September.
Mr. Kroger answered no.
Mr. Parker, Applicant with Synergy Building Systems, commented on three items that were mentioned at the October 7 council meeting. First, Mr. Parker shared that Council viewed the application favorably and believes the neighbor notification was the principal reason why the application was recommended to go back before the Planning Commission. Second, Mr. Parker stated that the existing drainage concerns in Pointe Oakwood are unrelated to this project. Third, Mr. Parker shared that the Applicant took time to determine the best court location and develop a robust vegetation screening plan to be considerate to the existing neighbors. The substantial landscape plan is above the code minimum. Mr. Parker closed his comments by mentioning the existing pickleball courts in Oakwood and the recently approved pickleball court in a residential area.
Mr. Aidt asked city staff about the drainage study.
Mr. Kroger shared that Public Works Director Doug Spitler and City Engineer Chris Kuzma reviewed and approved the plan.
