  1. The hours of operation are from 9 a.m. to 8 p.m.
  2. The applicant must work with city staff to develop a lighting plan to ensure the lighting is installed no higher than 12' and look into using a timer for the lighting.
  3. The applicant must restrict the use of the pickleball courts to Russell Total Wealth and Wellness employees, existing clients and potential clients.

SPECIAL USE STANDARDS

A.
The proposed use at the specified location is consistent with the Comprehensive Plan.
PRELIMINARY STAFF FINDINGS:
The Comprehensive Plan states that development should be compatible with the surrounding area. The addition of a pickleball court should have minimal impact on the surrounding neighborhood, given the nature of nearby commercial and residential properties. The pickleball court will be set back by approximately 76 feet from W. Schantz Avenue and approximately 138 feet from the east property line bordering the homes in Pointe Oakwood. The pickleball court will be effectively screened on all sides with vegetation to minimize the impact to surrounding properties.
It is important to note that tennis courts may be installed in all residential zoning districts by special use approval.
B.
The proposed building or use will not adversely affect or change the character of the area in which it is located.
PRELIMINARY STAFF FINDINGS:
What is being proposed should have minimal impact on the surrounding neighborhood as the proposed pickleball court is a reasonable distance away from other properties to minimize noise. The applicant is also proposing attractive landscape screening to soften the appearance of the pickleball court and should be a low-intensity use as compared to the general public as the pickleball court will be used by Russell Total Wealth and Wellness employees.
C.
That the establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort, convenience or general welfare.
PRELIMINARY STAFF FINDINGS:
There is nothing to suggest that public health, safety, morals, comfort, convenience or general welfare will be at risk.
D.
That the proposed use will not be injurious to the reasonable use and enjoyment of other property in the immediate vicinity for the purposes already permitted, or substantially diminish and impair property values within the neighborhood.
PRELIMINARY STAFF FINDINGS:
Because this would be an outdoor installation adjacent to residential properties, there is a possibility that lighting and unrestricted hours of operation could interfere with the reasonable use of neighboring properties. However, it appears that the applicant has made efforts to use modest lighting and to contain light-spill, and staff believes appropriate conditions can be fashioned to mitigate any concerns as to the hours of operation.
