Mr. Aidt opened the public hearing.

Law Director Rob Jacques swore in those providing testimony.

Paul Bohannon, 204 Pointe Oakwood Way, shared that he is the Treasurer and Board Member for the Pointe Oakwood Homeowners Association. He asked if the legal agreement between the City, Oakwood Investment Group and Hills Properties restricted uses of the top of the hill. He believes that there is a better location for the court.

Mr. Jacques shared that the legal agreement established procedures for an office building. The pickleball court is considered an accessory use that is not inconsistent with the use of that parcel as an office building.

Garett Orlowski, 205 Pointe Oakwood Way, shared that the pickleball courts at Orchardly Park should not be compared to the proposed pickleball court. Orchardly Park has been there for a long time and the neighbors that moved in knew that the park was there. When he and his wife purchased a home in Pointe Oakwood in 2019, they did not perceive having Lane Stadium and now possibly a pickleball court that close to their property. He said that the area is zoned for business and not recreation.

Mr. Jacques explained that this development is in the Multi-Use Special Planning (MUSP) zoning district. Regulations for the district are done via public hearings and special use permit.

Mr. Orlowski opined that the decisions being made for their small community are different than for older parts of Oakwood. He asked the Planning Commission to consider the Pointe Oakwood residents.

Marietta Orlowski, 205 Pointe Oakwood Way, shared that with a new city manager, there is an opportunity to mend the fractured relationship with the Pointe Oakwood residents. She disagreed that the only reason City Council denied the application was procedural.

Mr. Lauterbach asked city staff if they have any concerns with water runoff if the court is built.

Mr. Kuzma, City Engineer, stated that there is a storm sewer downstream that is more than adequate to handle runoff.

Mr. Lauterbach asked if city staff has received any complaints from Pointe Oakwood residents about drainage or flooding.

Mr. Kuzma said not to his knowledge.

Mr. Hill stated that he does not have any concerns recommending the application to City Council.

Mr. Aidt and Mr. Lauterbach agreed.

It was then moved by Mr. Hill and seconded by Mr. Lauterbach to recommend Council approval of Application #24-8, to amend the current Sugar Camp/ Pointe Oakwood Master Plan for the installation of a sports court (pickleball) to the existing site located at 1 Russell Place under the following conditions:
