4. Ordinance 26-432 — Appeal Authority / Ordinance Updates

Staff Presentation

Mike Gottfredson presented the ordinance update.

He stated that the proposed ordinance includes amendments needed to comply with recent state law changes regarding appeal authority and related land use procedures. He stated that the ordinance draft was not complete and had not yet been reviewed by the County Attorney. He requested that the public hearing be recessed to a date certain.

Commissioners’ Questions

Kevin Yack asked about which decisions go to the County Commission and which decisions are final decisions of the Planning Commission.

Mike Gottfredson explained that conditional use permits are administrative actions and that the Planning Commission has final decision-making authority on certain items, subject to the appeal process.

Connie Sweat asked about the difference between a public meeting and a public hearing in relation to appeals.

Mike Gottfredson and Duncan Kading explained the proposed appeal authority changes and the effect of state law.

Chairperson Nelson asked whether the ordinance would be reviewed by the attorney.

Mike Gottfredson stated that it would be reviewed.

Motion

Kevin Yack made a motion to recess discussion of Ordinance 26-432 to the July 1, 2026 Planning Commission meeting.

Connie Sweat seconded the motion.

Vote: Unanimous.

The motion passed.

Connie Sweat made a motion to approve the May 6, 2026 minutes as presented.
