Mr. Ivy made a motion to approve BZA 12-26 the appeal filed by Chris Hiatt with the hardship as stated in the application. Mr. Hamilton seconded the motion. Voting in favor: Mr. Billington, Mr. Hamilton, Mr. Hinds, Mr. Ivy, and Ms. Mathewson. Voting against: Ms. Fritch and Ms. Knapp. Motion carried (5-2), BZA 12-26 approved.

Jurisdiction: Board of Zoning Appeals

Being a continuation of a public hearing on the matter of an application filed by Troy A. and Jerri B. Tucker, requesting variances from the terms of the Delaware County Comprehensive Zoning Ordinance, to allow an increased height, and to allow the total square footage of all accessory structures to exceed that of the dwelling, all for a new barn, on premises located at 18709 North Little John Lane, Union Township, Delaware County, Indiana, as more accurately described in the application.

Troy Tucker, 18709 N. Little John Ln., Muncie, Indiana, appeared. He stated that the request was a for a steel building with a driveway, foundation, and electricity to be used for storage of his pontoon, RV, and truck. He stated that he grew up in the neighborhood which was mostly 1 acre lots that had more of a rural feel to them. He stated that he wanted to park his items inside to keep them protected from the weather. He stated that he had provided a new map showing the building would be 15’ from the side property line to meet the plat restriction and that his 2 closest neighbors had no opposition.

Ms. Mathewson asked if building would be for personal use only.

Mr. Tucker stated yes, there would be no business use and that they building would have nice windows and shutters.

Mr. Hinds asked if the driveway would extend to the road.

Mr. Tucker stated no, it would tie into the existing driveway.

Mr. Wiseley stated that there had been a previous concern about a plat restriction and that the building would now be in compliance.

Commissioner Brand appeared in support and stated that the applicant had taken care of the plat restriction concern and that they were looking to add value to their property and hoped that the board would approve the request.

No one appeared in opposition.

Ms. Swackhamer stated that they had received the updated site plan and that the building would now be 16’ from the side property line, and was similar to other requests that had been approved in the past.
