Ms. Fritch made a motion to approve BZA 14-26 the appeal filed by Lotus Muncie, LLC with the hardship as stated in the application. Mr. Hinds seconded the motion. Voting in favor: Mr. Billington, Mr. Hamilton, Mr. Hinds, Mr. Ivy, and Ms. Matheson., Voting against: Ms. Fritch and Ms. Knapp. Motion carried 5-2), BZA 14-26 approved.

Being a public hearing on the matter of an application filed by Azucena Carolina Lucero Martinez, requesting variances from the terms of the Delaware County Comprehensive Zoning Ordinance, to allow farm animals to be kept on less than 5 acres, and an enclosed chicken coop to be closer than 200’ to the neighboring dwelling, on premises located at 9209 South Center Road, Monroe Township, Delaware County, Indiana, as more accurately described in the application.
Julio Munoz, appeared to translate for the applicant. He stated that she had lived inside the city limits and was informed that she could not keep chickens so she moved to the county. He stated that she had purchased the house and was remodeling it at this time. He stated that she had a child with disabilities and that the chickens were for emotional support for that child. He stated that she would not be selling the eggs and that she had the chickens for over a year and that they were in a coop and being taken care of.
Ms. Mathewson asked if any of the neighbors had complained about noise from the roosters.
Mr. Munoz stated that Ms. Martinez stated no.
Ms. Mathewson asked if there were any complaints would she consider not having any roosters.
Mr. Munoz stated that Ms. Martinez stated yes.
Mr. Hinds asked if she had any intentions of having more chickens.
Mr. Munoz stated that Ms. Martinez answered no.
Mr. Hamilton asked how many chickens she had at this time.
Mr. Munoz stated that Ms. Martinez answered that she had 30-35 chickens.
Ms. Swackhamer stated that in her application Ms. Martinez was asking for 2 hens and 2 roosters.
Mr. Munoz stated that must have been a typo because they had 2 roosters and maybe 30-35 hens.
