Director's Report & Board Discussion
Ms. Swackhamer reported the year to date numbers for permits, inspections, complaints, variances, rezonings and plats. She also discussed updated AI-assisted minute preparation to which Board members expressed positive feedback. She reported an update on the UDO which includes an online portal added to the county website for public feedback. Consultant American Structurepoint is in the 'Educate Phase,' reviewing local codes, updating land use tables, and conducting legal compliance checks based on a 10-year BZA case history. Stakeholder meetings are tentatively scheduled for September 22 and September 23, 2026, at the Innovation Connector, covering eight target sector groups (builders/contractors, design professionals, economic development, non-profits/neighborhoods/land bank, agriculture, etc.). Site visits across 10 key locations are also set for September 24, 2026.
Ms. Swackhamer also discussed Article 10, Section 10 of the Plan Commission Rules of Procedure (adopted in 2020) authorizing a Hearing Officer (Executive Director) to hear minor BZA cases (minor setbacks, pre-existing conditions, property splits). Comparative data showed Delaware County heard 70 BZA cases YTD, dramatically higher than surrounding counties (e.g., Grant County 3, Richmond 18, Anderson 0), largely due to an outdated zoning ordinance and enforcement actions. Mr. Hinds stated concern regarding single-person decision-making versus a full 7-member vote and potential missed public opposition. Staff clarified that any case receiving public opposition or involving use variances would automatically route to the full Board.
