The Archaeological Field Reconnaissance assumes that no more than one archaeological site or human burials or remains are encountered. If more than one site is found or additional investigations are required (i.e. Additional Phase Ia), fees shall be negotiated in good faith at the time under a Supplemental Agreement of this contract.
The scope included in this agreement assumes that the project will not require a Cemetery Development Plan (CDP). If a CDP becomes necessary, fees shall be negotiated in good faith at the time under a Supplemental Agreement of this contract.
TASK 2. ECOLOGICAL SURVEY (WATERS OF THE US REPORT)
The CONSULTANT shall provide a Waters Report and Wetland Determination/Delineation for the Project by performing the following:
A.
Conduct a wetland determination at the project site.
B.
Examine and document the existing conditions, including soil characteristics, drainage ditches, hydrology, vegetation, and general topography.
C.
Data will be collected in the field to enable preparation of a formal Wetland Delineation Report in compliance with procedures established by the US Army Corps of Engineers Wetland Delineation Manual (Technical Report Y-87-1) and the 2008 U.S. Army Corps of Engineers - Midwestern Supplement.
D.
Natural features to be investigated and evaluated will include blue-line waterways as noted on the USGS topographic mapping of the corridor and other drainageways depicted on the Natural Resources Conservation Service Soil Survey of the project area which cross or flow immediately adjacent to the project, National Wetland Inventory mapped wetlands, other potential wetlands, and roadside drainage ditches. Documentation of site hydrology, vegetation, and soils will be collected on the basis of observed field conditions.
E.
The observed conditions will be compared to the standard criteria established by the Corps to determine the existence of regulated resources. An assessment will be prepared which evaluates the potential regulatory status of those resources. It is possible some resources may be regulated by the US Army Corps of Engineers under Section 404 of the Clean Water Act, while others may be isolated wetlands which are regulated by the Indiana Department of Environmental Management under the Indiana Isolated Wetlands Law.
The CONSULTANT shall submit the report to the United States Army Corp of Engineers and/or Indiana Department of Environmental Management, if applicable, for approval and determination.
This scope assumes that no wetlands will be discovered within the project limits. Wetland delineation, wetland mitigation, wetland replacement, permitting, agency coordination, design revisions, plan modifications, additional environmental documentation, and any other services required due to the discovery or suspected presence of wetlands are excluded from this scope. If wetlands are discovered or reasonably suspected during the performance of the work, fees shall be negotiated in good faith at the time under a Supplemental Agreement of this contract.
TASK 3. ENVIRONMENTAL PERMITTING
The CONSULTANT shall assist the LPA in securing the necessary environmental permits for the project by developing permit-compliant drawings, drafting the permit applications, and coordinating, applying for, and tracking the status of the permits until they are received. The CONSULTANT shall assist the LOCAL PUBLIC AGENCY in securing the environmental permits marked with an “x” in the box below:
Indiana Department of Environmental Management (IDEM) Section 401 Individual Permit
