had received no complaints since the notice had been mailed and that he had posted the orange signs as required. He stated that there were 15 similar structures on the other roads in the neighborhood and there were no issues with them. He stated that the garage would be on the northwest corner of his property behind his house where a neighbor had a fence.
No one appeared in opposition.
Ms. Fritch asked for clarification on the plat restrictions.
Ms. Swackhamer stated that the plat restrictions did not restrict the board in their authority over the zoning ordinance, and that even if the Board approved the request those restrictions could be acted upon and enforced by neighbors.
Ms. Ferguson stated that the applicant had been made aware of the restrictions.
Ms. Fritch made a motion to approve BZA 13-26 the appeal filed by Troy and Jerri Tucker with the hardship as stated in the application with the condition that the building be used for personal storage only and no business use. Mr. Billington seconded the motion Voting in favor: Mr. Billington, Mr. Hamilton, and Ms. Mathewson. Voting against: Ms. Fritch and s. Knapp. Motion failed, BZA 13-26 automatically continued to the April 30, 2026 meeting.

Being a continuation of a public hearing on the matter of an application filed by Game of Homes, LLC., requesting a variance of use from the terms of the City of Muncie Comprehensive Zoning Ordinance, to allow two dwellings in a single-family residence zone, and a variance to allow a reduced rear setback for one of the dwellings, on premises located at 1006 West Wayne Street, Muncie, Indiana, as more accurately described in the application.
Ms. Swackhamer stated that there was no one here to represent the applicant at this time.
Ms. Mathewson stated that this was the second meeting where no applicant had been present and asked what options the board had on this matter.
Mr. Wiseley stated that the Board could continue the matter to the next meeting or take final action.
Ms. Matheson asked if the Board chose to take final action, would that be through a motion and vote of approval or denial like usual.
