Commissioner Brand appeared and stated that this property was in his district. He stated that he had lived in Monroe Township for 57 years and that he would ask the Board to approve the request and that he would approve the 0’ setback when this comes to the Commissioners.

Ms. Fritch made a motion to approve BZA 09-26 the appeal filed by Heather Jones with the hardship as stated in the application with the following conditions; 1) That the variance be for hens only and no roosters and; 2) That the variance be for the applicant only and will not transfer with the property. Ms. Knapp seconded the motion. Voting in favor: Mr. Billington, Ms. Fritch, Mr. Hamilton, Ms. Knapp, and Ms. Mathewson. Voting against: none. Motion carried, BZA 09-26 approved.
Being a public hearing on the matter of an application filed by The Flower Bin Inc. and Smalls Sliders, requesting variances from the terms of the City of Muncie Comprehensive Zoning Ordinance, to allow no designated loading/unloading area, to allow the building façade to be metal rather than natural materials, to allow reduced foundation plantings on the east side of the building, and to allow a reduced front greenbelt, all for a new restaurant on a corridor road, on premises located at 211 West McGalliard Road, Muncie, Indiana, as more accurately described in the application.
Bill Terry, Weihe Engineers, appeared to represent the applicant. He stated that they were working with staff to submit a site plan reducing the number of variances needed down to the 4 listed.
Ms. Mathewson stated that the corridor standards were in place to address some of the issues and that this appeared to be corrugated metal which stood out like a sore thumb in that area. She asked if they had discussed using a different material to make it look a little nicer.
Mr. Terry stated that this was a pre-fabricated building which was the standard for the applicant and that the cost of brick would make this too expensive.
Ms. Mathewson stated that a letter form the City Engineer was received discussing the configuration of lanes and asked if that was part of the site plan that needed approval.
Mr. Terry stated that was for the drive on the west side of the lot and that they had shifted it towards to east and would be a right turn in and right turn out only.
