Family & medical leave policy

1. Family & medical leave

A. Introduction

Family and Medical Leave under Federal law is an unpaid employee leave of absence. This Family and Medical Leave Policy complements, and is coordinated with sick leave, vacation, or other paid and unpaid leave policies of the Town.

B. Eligibility1

An employee will be eligible to seek a Family and Medical Leave if:

  1. The employee has worked for the Town at least twelve (12) months, and
  2. The employee has worked at least 1,250 hours during the twelve (12) months before the leave.

C. Types of family & medical leave

  1. Employees may qualify for Family and Medical Leave for any of the following reasons:
    1. Birth, adoption, or foster care placement of a child and for care of that child (leave must be completed within twelve (12) months of the child's birth, adoption, or foster care placement);
    2. Leave to care for a seriously ill or injured spouse, parent, or child under age eighteen (18) (or eighteen (18) years old or over who is incapable of self-care); or
    3. Leave because of an illness or injury that makes the employee unable to perform his/her job.
  2. The injury or illness must be a "serious health condition." "Serious health condition" means any illness, injury, impairment which involves:
    1. Inpatient hospitalization;

1 In some circumstances, employees who do not meet these conditions may be eligible to take leave for the purpose of giving birth or for adopting a child as determined by state law.
