Ms. Mathewson asked if they had people living there since November.

Mr. Case stated that they had purchased the property December 26th, 2025 and that they had residents there for approximately 21 days until the fire marshal informed them of some fire code issues.

Mr. Blevins stated that since it was a commercial property they thought that they were ok and realized the problem when they applied for the change of occupancy with the City Building Commissioner. He stated that they moved everyone out by January 31st and that they had not intentionally broken the rules. He stated that the police report he had provided was from an incident that happened 2 blocks away and ended up on their property. He stated that safety was a concern for everyone and that that wanted the neighbors to feel safe. He stated that he did not want to have a sober living house where drugs were nearby and that he would have no issues calling the police.

Ms. Mathewson asked if there were cameras facing all areas of the property.

Mr. Blevins stated that they had cameras but that they were waiting for the approvals to finish the rest of the work. He stated that they were not inside yet but would be facing every doorway so that they could monitor activity.

Ms. Mathewson asked if someone was no following the rules how would that be dealt with.

Mr. Case stated that any violations including curfew, that individual would be escorted from the property to other housing. He stated that they would not be thrown out on the street but that they would be removed. He stated that they used a state background check that cannot be forged. He stated that these individuals were no longer in active addiction when they enter this sober living program. He stated that the residents know how serious it was if they broke the rules because this was for individuals that wanted to improve. He stated that they were not to bother the neighbors or be on their properties and that they would do everything that they could to make them feel safe. He stated that if that meant having sit down meetings with the neighbors or placing a fence around the property that they would be open to that.

Ms. Fritch made a motion to approve BZA 02-26 the appeal of Kingdom Recovery, LLC with the hardship as stated in the application with the following conditions; 1) That that variance be for the applicant only and not transfer with the property; 2) That all necessary approvals such as Fire Department, Health Department, Building Commissioner, etc. be obtained prior to the start of business; and 3) That there shall be a limit of 12 residents. Mr. Billington seconded the motion. Voting in favor: Mr. Billington, Mr. Fritch, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: None. Motion carried, BZA 02-26 approved.
